.. O yj APPENDIX NOTICE OF VIOLATION Tennessee Valley Authority Docket Nos. 50-259 Browns Ferry Nuclear Power Plant 50-260 50-296 License Nos. DPR-33 DPR-52 DPR-68 EA 81-83 As a result of the July 27, 1981 submittal from Tennessee Valley Authority in response to the July 1,1981 NRC request for information on emergency planning and in accordance with Interim Enforcement Policy, 45 FR 66754 (October 7, 1980),

the following violation was identified:

10 CFR 50.54(s)(2) and Section IV.D.3 of Appendix E, require that by July 1, 1981, each nuclear power reactor licensee demonstrate that administrative and physical means have been established for alerting and providing prompt instructions to the public within the plume exposure pathway of the Emergency Planning Zone ~within about 15 minutes.

Contrary to the above, Tennessee Valley Authority was unable to demonstrate that means had been established for alerting and promptly providing public instruction within the plume exposure pathway of the Emergency Planning Zone within about 15 minutes.

This is a Severity Level IV violation.

(Supplement I)

Pursuant to the provisions of 10 CFR 2.201, Tennessee Valley Authority is hereby required to submit to this office within 30 days of the date of this Notice, a written statement or explanation in reply, including:

(1) admissico or denial of the alleged item of noncompliance; (2) the reasons for the item of noncompliance if admitted; (3) the corrective steps which have been taken and results achieved; (4) corrective steps which will be taken to avoid further items of noncompliance; and (5) the date when full compliance will be achieved.

Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, 42 U.S.C 2232, this response shall be submitted under oath or affirmation.

The responses directed by this Notice are not subject to the clearance procedures of the Office of Managment and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
