'INDINGS:

IO CFR 50.54(q) requires that a nuclear power reactor licensee follow and maintain in effect an emergency plan which meets the requirements of Appendix E to IO CFR Part 50.Section V of Appendix E requires a licensee to submit one copy of any changes to the emergency plan to the Administrator of the appropriate NRC Regional Office and two copies to the Document Control Desk within 30 days of such changes.

Contrary to the above, Revision l6 of the Radiological Emergency Plan, dated September 27, l985, had not been sent to the appropriate NRC offices as of February I 8, I 987.

RESPONSES:

I. FPL concurs with the violation.

2. Due to an administrative oversight, Revision l6 of the St. Lucie Plant Radiological Emergency Plan (E Plan) was not submitted to the NRC within 30 days of final company approval. During a February 19, I 987, conversation with a NRC Region II Emergency Planning Section staff member, the fact that the NRC had not received Revision l6 of the St.

Lucie Plant Radiological Emergency Plan was identified.

3. FPL promptly reviewed their records to verify that all changes to the E Plan and its implementing procedures had been submitted to the NRC. It was determined that the failure to submit the document in question (St. Lucie E Plan, Revision 16) was an isolated incident. FPL submitted the St. Lucie Plant E Plan, Revision l6 to the NRC on February 25, I 987, Letter L-87-88.
4. FPL developed an action plan for submittal of all changes of the E Plan and its implementing procedures to the NRC within 30 days of final company approval. This action plan incorporates a computer based tracking program and assignment of responsibilities for administrative control of the E Plan and implementing procedure submittals to NRC. This action plan was implemented on February 27, I 987.
5. Full compliance was achieved on February 25, I 987.
