Our letters of April l9, l 983 (L-83-230) and October l3, l983 (L-83-521), committed to provide a "Thermal Shield Failure Analysis" pursuant to .the St. Lucie Unit' Plant Recovery Program (Item B. from our L-83-230), by October 27, I 983. The documentation herein contained, satisfies item B. of our L-83-230.

Portions of Attachment (2) of this letter contain proprietary information, pursuant to the provisi ons of I 0 CFR 9.5(4), as discussed in Attachment (I ) (Combusti on Engineering, Inc., Statement for Withholding fro'rn Public Disclosure Pursuant to IO CFR 9.5 (4) ). Combustion Engineering has requested that Attachment 2 be returned upon receipt of the final version, currently scheduled to be provided on or about December I5, I 983. is a pre-issuance copy of Chapter 7, entitled "Failure Mechanism Analysis," of the final report on St. Lucie Unit I operation without a thermal shield and with a repaired core support barrel. It has been understood from your letter of April 26, l983, that Thermal Shield Failure Analysis was not required to be provided prior to return to power of St. Lucie Unit I. However, schedular delays in the recovery operation have allowed this report to be provided prior to the estimated return to power. Conclusions therein contained are solely those of Combustion Engineering. At this stage of the recovery, Florida Power 8 Light is not in the position to agree or disagree with those conclusions.

Remaining information submittal dates, updating our letter of October l3, l983 (L-83-52I) and the tentative dates of your letter of April 26, l 983, are as follows:

Statement for Withholding from Public Disclosure Pursuant to 10CFR9.5(4)

The material transmitted herewith, Chapter 7, Failure Mechanism Analysis, contains information previously designated as proprietary by Combustion Engineerino, Inc. in References 1 and 2. Pursuant to the provisions of 10CFR9.5(4) of the Commission's regulations, we request that the material be withheld from public disclosure and that this material be safeguarded. We believe that withholding this proprietary material will not adverely affect the public interest. The reasons for the classification of this information as proprietary are:

. The use of the information by a competitor would substantially decrease his expenditures, in time or resources, in designing, producing or marketing a similar product.

The information consists of test data or other similar data concerning a process, method or component, the application of which results" in a substantial competitive advantage to Combustion Engineering, Inc.

The information reveals special aspects of a process, method, component or the like, the exclusive use of which results in a substantial competitive advantage to Combustion Engineering, Inc.

The information contained in the enclosure is meant to be part of the formal basis for official action by the NRC Staff concerning the St. Lucie Unit 1 thermal shield removal effort. The submittal of the subject 'information prior to formal issuance of the final report on St. Lucie 1 operation 'without a thermal shield is meant to facilitate an efficient and timely review by the NRC staff. C-E has not made a detailed determination of proprietary information for this material in its present form. Such determination will be made when the information is reviewed as an integral part of the final report. Florida Power and Light wi 11 submit an application for withholding from public disclosure the subject information, along with the appropriate affidavit, delineation of proprietary material, and non-proprietary version when they.
