Dear Mr. Dietch:

SUBJECT:

EXEMPTION - FIRE PROTECTION (APPENDIX R), INSTALLATION OF BATTERY POWERED EMERGENCY LIGHTING INSIDE CONTAINMENT RE:

San Onofre Unit 1 By application dated December 22, 1981, you requested an exemption from Section IlI.J of Appendix R to 10 CFR Part 50 to the extent that it requi.res the installation of battery powered emergency lighting within containment.

Based on our review of your submittal, the Commission has determined that pursuant to 10CFR 50.12, an exemption is authorized by law and will not endanger life or property or the common defense and security and is otherwise in the public interest. Accordingly, the exemption has been granted (enclosed).

A copy of the Exemption is being filed with the Office of the Federal Register for publication.

Your request dated November 4, 1981, for an exemption from the schedul-ar requirements of 10 CER 50.48(c)(5) for the submission of plans and schedules for a safe shutdown capability at San Onofre Unit 1 to approximately six months after completion of Systematic Evaluation Program (SEP) is currently under review.

Sincerely, OriRgihl signed by Dennis D. Crutchfield, Chief Operating-Reactors Branch #5 Division of Licensing
