SUBJECT:

HATCH NUCLEAR PLANT, UNITS 1 AND 2 - FACSIMILE TRANSMISSION OF DRAFT REQUEST FOR ADDITIONAL INFORMATION (TAC NOS. MC3875 AND MC3876)

A facsimile containing questions was transmitted on October 29, 2004, to Mr. Ray Baker of the Southern Nuclear Operating Company. The questions supported conference calls with the licensee held on December 1, 2004, and February 24, 2005, regarding the licensees submittal dated July 20, 2004. The licensees application proposed to revise Section 5.3.1 of the Edwin I. Hatch, Units 1 and 2 Technical Specifications to support the licensees initiatives to achieve fleet standardization and reduce regulatory burden regarding the qualification requirements of certain staff positions. This memorandum and the attached questions do not convey or represent an NRC staff position regarding the licensees request. A 30 day response time was requested during the February 24, 2005, call.

DRAFT REQUESTS FOR ADDITIONAL INFORMATION LICENSE AMENDMENT REQUEST UNIT STAFF QUALIFICATIONS SOUTHERN NUCLEAR OPERATING COMPANY HATCH NUCLEAR PLANT, UNITS 1 AND 2 DOCKET NOS. 50-321 AND 50-366 The proposed technical specification (TS) revision adds the following statement to the end of TS 5.3.1. "Personnel who complete and accredited program which has been endorsed by the

[Nuclear Regulatory Commission] NRC shall meet the requirements of the accredited program in lieu of the above." [referring to the commitment to the criteria in ANSI N18.1-1971 and Regulatory Guide (RG) 1.8]

1. Clarify what "accredited program which has been endorsed by the NRC" is being referenced by this statement.
2. Clarify that this "in lieu of" statement is on a position-by-position basis (i.e., the individual completing the accredited program for a certain position, will meet the program requirements in lieu of the ANSI / RG criteria corresponding to that position. As written, this TS can be read to say that if an individual completed an NRC endorsed accredited program as a junior health physics (HP) technician, they qualify as the Radiation Protection Manager, if they are the senior HP in charge (or even qualify to be the maintenance supervisor).
