PageIof4VIOLATIONA(l)A.10CFR20.311(d)(l)requiresanygeneratinglicenseewhotransfersradioactivewastetoalanddisposalfacilitytoprepareallwastesso'thatthewasteisclassifiedaccordingto10CFR61.55andmeetsthewastecharacteristicrequirementsin10CFR61.56.10CFR61.56(b)(l)statesthatwastemusthavestructuralstabilitywhichwillgenerallymaintainitsphysicaldimensionsanditsformunderexpecteddisposalconditions.10CFR61.56(b)(2)statesthatinnocaseshalltheliquidexceedone(I)percentofthevolumeofthew'astewhenthewasteisinadisposalcontainerdesignedtoensurestability,or0.5percentofthevolumeofthewasteforwasteprocessedtoastableform.10CFR20.311(d)(3)statesthatanygeneratinglicenseewhotransfersradioactivematerialtoalanddisposalfacilityshallconductaqualitycontrolprogramtoassurecompliancewith10CFR61.55and61.56whichmustincludemanagementevaluationofaudits.Contrarytotheabove,thelicenseefailedtoadequatelyprepareradioactivewastefordisposalasfollows:I)Therequirementsforstructuralstabilityandminimumvolumeofliquidinwastewerenotmetinthat,onNovember24,1986,RadioactiveWasteShipmentNo.86-61consistingofsludgesolidifiedwithcement,packagedintwosteellinerswasimproperlysolidifiedinthatapproximatelyfifteenpercentofthecontentsofonelinerhadfailedtosolidifywhiletheentirecontentsofthesecondlinerwerepaste-likeinconsistency.RESPONSETOVIOLATIONA(l)A.I.FPLagreesthatthetwolinersinRadioactiveWasteShipmentNo.86-61werenotproperlysolidified.FPLdoesnotagreethattherequirementforminimumvolumeofliquidinwastewasnotmet.ThetestsconductedbySouthCarolinaDepartmentofHealthandEnvironmentalControl(SCDHEC),FPL,andChemNuclearindicatedthecriteriaforminimumvolumeofliquids(0.5%)hadbeenmet.2.Analysisofthematerialinthelinersindicatedthatpropersolidificationdidnottakeplacedueto:a)Insufficientmixingofwasteandprocesschemicals.b)Generationofammonia(duetothewasteform)whichinhibitedsolidification.,GRM3/25/I

Page2of43.ThelinerswerereturnedtoSt.Lucie,cutopen,andtheunsolidifiedmaterialwasremovedandreprocessedandre-packaged.Solidificationwasverifiedbymanualsoundings(tapping)onthelinerandrandomcoreboring.Thelinersweresubsequentlytransportedtotheburialsite,re-testedbytheSCDHEC,foundtobeacceptableandburied.Theremaining"solidified"linerscontainingthesamematerialweresubjectedtothesameon-sitetesting.Onelinerwasfoundtobesuspect.ThevendorreceivedpermissiontoshipthelinertohissiteforfurthertestingandanalysisfromSCDHEC.Whenthelinerwascutopenatthevendor'ssite,itwasfoundtobeasolidifiedfree-standingmonolith.Subsequently,thelinerwasre-sealedandburied.Theremaininglinerscontainingthismaterialwerealsotestedsuccessfullyandburied.4.Vendoron-sitesolidificationhasbeenstopped.NofurthersolidificationwilltakeplaceuntilchangestakeplaceintheProcessControlProgramtogiveassuranceoffullcompliance.5.Compliance(withrespecttotheproblemmaterial)wasachievedbyApril7,I987.VIOLATIONA(2)2.Thelicensee'squalitycontrolprogramtoassureappropriatecharacterizationofwastewasinadequateinthatitcontainednorequirementsforlicenseeevaluationand/orverificationofvendoractivitiesandasaconsequence,onNovember24,l986,thecontentsofthetwosteellinersdescribedabovewerenotsolidasrequired.RESPONSETOVIOLATIONA(2)I.FPLconcurswiththeviolation.2.FPLimproperlyassumedthatthevendor'squalityprogramconcurrentwiththeprocessverificationassuredanacceptableproduct.3.On-sitesolidificationprocesseswereterminated.4.Priortosolidificationtakingplaceon-site,FPLwillhavecontrolsinplacewhichwillprovidereasonableassurancethatthesolidificationis'completepriortoshipment.5.Fullcompliancewillbeachievedpriortoon-sitesolidificationofradioactivewasteforshipment.GRM3/25/2

Page3of4VIOLATIONBB.IOCRF7I.5(a)requireseachlicenseewhotransportslicensedmaterialoutsideoftheconfinesofitsplantorotherplaceofuse,orwhodeliverslicensedmaterialtoacarrierfortransport,tocomplywiththeapplicablerequirementsoftheregulationsappropriatetothemodeoftransporttotheDOTin49CFRPartsl70throughI89.49CFRI73.475(i)statesthatbeforeeachshipmentofanyradioactivematerialspackage,theshippershallensurebyexaminationorappropriateteststhatexternalradiationandcontaminationlevelsarewithinallowablelimits.Contrarytotheabove,thelicenseefailedtocomplywiththerequirementsoftheDOTinthatnosurveysoftheundersideofthetransportvehicleswereperformedforradioactivematerialshipments:No.86-46onSeptember23,l986;No.86-47onOctober2,l986;No.86-49onOctober9,l986,No.86-52onOctoberl4,1986,No.86-53onOctober2I,I986;andNo.86-54onOctober23,1986.RESPONSETOVIOLATIONBI.FPLconcurswiththeviolationonthebasisthatdocumentedevidencewasnotavailabletoindicatetheundersideradiationsurveyswereperformedfortheseshipments.However,FPLbelievesthatsurveyswereperformedtoinsurecompliancewithshippingrequirementsofthetransportvehicle.AdditionalsurveystakenbytheStateofFlorida,priortotheshipmentleavingthesite,verifiedthattheradiationlimitsincludingtheundersideofthetransfervehiclewerewithinspecification.2.Thecauseforthefindingwasthatsurveydocumentsdidnotprovidealocationforrecordingdoseratesfromtheundersideofthetransportvehicle.3.Vehiclesurveysheet(HPS-65.l,2,3,&4)willbechangedtoprovideforrecordingdoseratesfromtheundersideofthetransportvehicles.Appropriatedoserateswererecordedonsubsequentshipments.4.HealthPhysicsProcedureHP-00,ShippingofRadioactiveMaterial,willberevisedtorequirerecordingofdoseratesfromtheundersideofthetransportvehicle.5.FullcompliancewasachievedAprilI,l987.ProcedurechangeswillbeincorporatedbyMay30,I987.GRM3/25/3
