4 NOTICE OF VIOLATION Detroit Edison Company Docket No.: 050-341 Fermi 2 License No.: NPF-43 During an NRC inspection conducted on May 4 through June 18,1998, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violation is listed below:

10 CFR 50.59, " Changes, Tests, and Experiments," Paragraph (b)(1) requires, in part, that the licensee shall maintain records of changes in the facility as described in the safety analysis report. These records must include a written safety evaluation which provides the bases for the determination that the change does not involve an unreviewed safety question.

Contrary to the above, :nspectors and the licensee identified on November 21,1997, that since initial plant licensing the operators were making changes to the facility as described in the safety analysis report by defeating various control room annunciators without performing a written safety evaluation. A control room annunciator is defeated by a physical or electronic block, preventing it from operating when a system parameter reaches the alarm setpoint, constituting a change to the facility as described in the Safety Analysis Report.

This is a Severity Level IV violation (Supplement 1).

The NRC has concluded that the information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed in the attached inspection report. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 of the description therein Joes not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D. C. 20555 with a copy to the Regional Administrator, Region 111, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
