By letter dated November 9,1998, Northeast Nuclear Energy Company (NNECO) submitted a request for NRC review and approval of its leak-before-break (LBB) evaluation conceming the i

Millstone Nuclear Power Station Unit 2 pressurizer surge line piping. NNECO's submittal was made in accordance with the provision of Title 10 of the Code of Federal Regulations, Part 50 (10 CFR 50),' Appendix A, General Design Criteria 4, which permits licensees to exclude the dynamic effects associated with postulated pipe ruptures from the facility's licensing basis if

' system piping rupture is extremely low under conditions consistent with the design basis for the piping." _ LBB evaluations utilizing the guidance of NUREG-1061, Volume 3 and/or Draft Standard Review Plan Section 3.6.3 have been previousy approved by the staff as a method for making such a demonstration. NNECO also supplentnted their original submittal with

) responses on February 26 and March 5,1999, to the NF:C staff's requests for additional information.

The staff has completed its evaluation of the NNECO st.braittal. The information provided by l NNECO in its submittal and in response to the NRC staf rs questions was sufficient to permit the staff to indopendently evaluate the licensee's conclusions. While the results of the staff's l evaluation do differ from NNECO's in some respects, the staff agrees with the licensee's conclusion that LBB behavior has been demonstrated for the pressurizer surge line piping given the licensee's commitment to incorporate operational limits on the pressurizer-to-hot leg temperature gradiant as stated in their February 26,1999, letter. Therefore, the staff finds that NNECO may remove consideration of the dynamic effects associated with the postulated
