  1. ' Ion December 30, 1982, I received from you a copy of the Meniorandum,. dated December 28, 1982, from Richard H.

Vollmer. to Joseph Halapatz concerning the resolution of Mr. -

Halapatz' Differing Professional Opinion (DPO). The County's consultant, Dale Bridenbaugh, has also had an opportunity to review that document. -

.~~  ;:Unfortunately, the discussion in the Memorandum is extremely general; it contains no-information whatsoever '

concerning the anticipated implementation of the Staf f con-clusions set forth therein. In addition, the County has not yet been furnished with the pertinent documents concerning the ,

^ Monticello inspection program which is referenced throughout

the Memorandum. As you know, the County's request for these documents has been outstanding for quite some time; moreover, on December 21, 1982, the Board ordered that the documents be furriished to the County by December 30, 1982. Needless to say,:.it is impossible to evaluate in any meaningful fashion the Staff discussion contained in the Vollmer Memorandum with-out having access to the pertinent Monticello information.

--..Furthermore, in addition to the County's need for the' Monticillo information, we have several.' questions, which are se't forth below, concerning the substance of the Memorandum and the' Staf f's position on this matter with respect to Shoreham. The County must obtain answers to these questions before a determination can be made as to whether it will be ,

necessary to litigate the issues raised by the DPO. Accordingly, please provide answers to the following questions as soon as possible:
