SUMMARY

OF MANAGEMENT ACTIONS Suspensions based on presumptive positives: 0 Reportable events: 0 Appeals/Resolutions: During the time period July 1, 1994 to December 31, 1994, eleven appeals have been resolved. No appeal's resulted in reversal of original action.

  • Two fitness-for-duty appeals involved claims that over the counter medications or food products contributed to positive drug and alcohol test results.
  • Five appeals resulted from access denials based on security determinations of lack of trustworthiness and reliability.
  • Two psychological appeals were the result of access denials based on histories of prior, as well as current, alcohol and drug use.
  • One psychological appeal resulted from the determination that drug rehabilitation requirements had not been adequately met.
  • One fitness-for-duty appeal involved an allegation that a procedural error occurred during the positive test result notification process.

Trends: 1990 to Present o Opiates: No MR_O positives since the Fitness-For-Duty rule went into effect.

o *PCP: No postives for the second consecutive year.

o Rare challenges to the accuracy and validity of HHS laboratory test results.

Recommendations:

o Eliminate the second breath alcohol test when the first test is negative.

After greater than 70,000 breath tests, equipment sensitivity of 100% has been demonstrated [second breath test has never been positive after the first breath test was negative]. Cost savings over months to years would be considerable.

AIWA designed and is implementing a program with only one breath alcohol screen.

o Continue to permit/encourage on-site pre-screening.

o Consider moving toward "interchangeability" and mutual acceptance among regulated Fitness-For-Duty programs INRC, DOT, RSPA).

Comments:

This six month reporting period concludes the first year in which random testing was conducted at the reduced rate of 50% of the actively-badged population. Listed- below is a statistical comparison of drug and alcohol testing performed in various categories during 1993 and 1994.

o From a cost benefit standpoint, pre-access testing continues to be the most effective screening tool.

o Number of confirmed positives {all categories) has been reduced by approximately 50%

from 1993 to 1994.

o There was a notable increase in the number of "For Cause" tests conducted in 1994.

o Due to the consistent number of pre-access tests performed in 1993 and in 1994, the 50% reduction in the random testing rate resulted in only a 25% reduction in total tests performed.
