Dear Mr. Pollock:

On December 2, 2008, the U.S. Nuclear Regulatory Commission (NRC) completed an inspection at your Indian Point Energy Center. The enclosed inspection report documents the inspection results, which were discussed on December 2, 2008, with Mr. Daniel Gagnon and other members of your staff during an exit meeting.

The inspection examined activities conducted under your licenses as they relate to the identification and resolution of problems, and compliance with the Commission=s rules and regulations and with the conditions of your operating licenses. Within these areas, the inspection involved examination of selected procedures and representative records, observations of activities, and interviews with personnel.

On the basis of the sample selected for review, there were no findings of significance identified during this inspection. The inspector concluded that problems related to the Fitness-for-Duty program were properly identified, evaluated, and resolved within the problem identification and resolution program (PI&R).
