INDIAN POINT NUCLEAR GENERATING UNIT NOS. 2 AND 3 - CORRECTION TO THE TECHNICAL SPECIFICATIONS TO REFLECT APPROPRIATE PAGES REMOVED AND RETAINED BY PREVIOUS LICENSE AMENDMENTS

Dear Jean Fleming:

The U.S. Nuclear Regulatory Commission (NRC) is reissuing the enclosed Page No. 1 of the attachment to Amendment No. 299 for the Indian Point Nuclear Generating Unit No. 2 (IP2) and Page No. 1 of the attachment to Amendment No. 275 for the Indian Point Nuclear Generating Unit No. 3 (IP3). These amendments, which implement the technical specification (TS) changes associated with permanent removal of spent fuel from the IP2 and IP3 spent fuel pits, were approved and issued by the NRC on November 29, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23242A275).

The reissued pages update the amendatory instructions of the license amendments, which previously instructed the licensee to remove the existing pages of Appendix A, Technical Specifications, from the IP2 Renewed Facility Operating License (RFOL) No. DPR-26 and the IP3 RFOL DPR-64 and replace them with four updated TS pages. However, the insertion instructions from these amendatory pages failed to make it clear that the licensee was to retain several additional TS pages for both IP2 and IP3 that were not a part of the original license amendment request (ML22306A126; November 2, 2022) and were not otherwise changed or affected by the approval of these license amendments.

In order to make clear that these additional TS pages continue in effect at both IP2 and IP3 and were not intended to be removed or revised by the changes made as part of Amendment No. 299 to RFOL No. DPR-26 and Amendment No. 275 to RFOL No. DPR-64, the NRC is addressing this administrative error by reissuing the amendatory instruction pages for both amendments to include all applicable pages of the IP2 and IP3 TS. Holtec Decommissioning International, LLC (HDI), Holtec Indian Point 2, LLC, and Holtec Indian Point 3, LLC, the licensees for IP2 and IP3, have indicated that the requirements included in these additional TS pages, which relate to the requirements for high radiation areas, have remained in effect at both units since the issuance of Amendment No. 299 and Amendment No. 275. HDI also generated an incident report related to the implementation of these amendments to ensure that the current TS for IP2 and IP3 used at the site are correct, complete, and accurate for the two units.

The use of potentially confusing language in the amendatory instructions for Amendment No.

299 and Amendment No. 275 for IP2 and IP3, respectively, was an administrative error and February 22, 2024

Fleming does not reflect the current licensing basis or associated conditions applicable to IP2 and IP3 at this stage in the decommissioning process (i.e., with all fuel removed from the spent fuel pits and stored in the onsite independent spent fuel strange installation (ISFSI), an action that was completed on February 1, 2023, for IP2 (ML23046A102)) and October 16, 2023, for IP3 (ML23289A158)). As such, Page No. 1 of the attachments to both Amendment No. 299 for IP2 and Amendment No. 275 for IP3 are being reissued to correct this administrative error and ensure current and complete licenses and TS are in place as the site transitions into ISFSI-only status with all spent fuel in dry storage.

The corrected version of Page No. 1 of the attachment to Amendment No. 299 for IP2 and Page No. 1 of the attachment to Amendment No. 275 for IP3 are enclosed and reflect clarified amendatory instructions. Replacement of the current Page No. 1 of the attachments to both Amendment No. 299 for IP2 and Amendment No. 275 for IP3 with the enclosed corrected pages will ensure that the facility has a correct and current license document for both the Indian Point units. The actual revised TS pages issued by the NRC in association with Amendment No. 299 and Amendment No. 275 for IP2 and IP3, respectively, remain correct and should be used and implemented in conjunction with the remaining TS pages that were unaffected by these amendments.
