INDIAN POINT NUCLEAR GENERATING UNIT NO. 2 - ISSUANCE OF AMENDMENT NO. 297 TO RENEWED FACILITY OPERATING LICENSE NO.

DPR-26 TO REVISE THE TECHNICAL SPECIFICATIONS AND MODIFY STAFFING REQUIREMENTS FOLLOWING PERMANENT TRANSFER OF ALL SPENT FUEL TO DRY STORAGE (EPID L-2022-LLA-0112)

Dear Jean Fleming:

The U.S. Nuclear Regulatory Commission (NRC) has issued the enclosed Amendment No. 297 for Renewed Facility License (RFL) No. DPR-26 for the Indian Point Nuclear Generating Unit No. 2 (IP2), operated by Holtec Decommissioning International, LLC (HDI). The amendment is in response to HDIs application dated August 2, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22214A128). The amendment revises the RFL and associated Technical Specifications (TS) to reflect the removal of all spent nuclear fuel from the IP2 spent fuel pit (SFP) and its transfer to dry cask storage within an onsite Independent Spent Fuel Storage Installation (ISFSI).

These changes reflect the permanently shut down status of the decommissioning facility, as well as the reduced scope of structures, systems, and components necessary to ensure plant safety now that all spent fuel has been permanently moved to the Indian Point Energy Center ISFSI.

The license amendment and revised TS also modify the IP2 staffing requirements in Appendix A, Permanently Defueled Technical Specifications, and revise the 10 CFR Part 50 Facility License and Appendix C, Inter-Unit Fuel Transfer Technical Specifications. This includes prohibiting the transfer of Indian Point Nuclear Generating Unit No. 3 spent fuel to the IP2 SFP.

The license amendment and TS changes are provided as Enclosure 1. The changes are effective upon issuance and shall be implemented within 60 days.

A copy of the related safety evaluation is provided in Enclosure 2. A Notice of Issuance will be included in the Commissions monthly Federal Register notice.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS.
