Singh Technology Campus, 1 Holtec Blvd., Camden, NJ 08104 Telephone (856) 797-0900 Fax (856) 797-0909 Holtec Indian Point 2, LLC (IP1 & IP2) and Holtec Indian Point 3, LLC (IP3), collectively referred to as Indian Point Energy Center (IPEC), requested exemptions from portions of 10 CFR 50.47(b), 10 CFR 50.47(c)(2), and 10 CFR Part 50, Appendix E, Section IV. The requested exemptions would allow HDI to reduce IPEC emergency planning requirements consistent with the permanent shutdown and defueled condition of Indian Point 1 (IP1), Indian Point 2 (IP2), and Indian Point 3 (IP3). In Reference 2, HDI submitted a revision to the exemption requests with a supplement comprised of site-specific calculations.

The NRC staff review of HDIs request, Reference 3, concludes that HDIs submittal contains technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. In Reference 4, HDI responded to the NRC staffs request for additional information to support the NRC staff review.

In Reference 3, NRC staff estimated their review and Commission approval should be expected by January 25, 2023. HDI decommissioning project plans used this date in good faith based on precedence at other decommissioned facilities. Specifically, the NRC granted similar exemptions to Exelon for Three Mile Island-1, HDI for Pilgrim, Exelon for Oyster Creek, OPPD for Fort Calhoun Station, Entergy for Vermont Yankee; Southern California Edison Company for San Onofre Nuclear Generating Station, Units 1, 2, and 3; Duke Energy Florida, Inc. for Crystal River 3; and Dominion Energy Kewaunee, Inc. for Kewaunee Power Station.

This letter requests a proposed updated date for Commission approval of the above-requested exemptions. The delay in approval from the expected approval date of January 25, 2023 has resulted in workforce and schedule uncertainties.

This letter contains no new regulatory commitments.
