Dear Chief Perry:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your July 17, 2023, letter in which you expressed opposition, on behalf of the Ramapo Munsee Nation, to any release of radioactive waste from the Indian Point Energy Center (IPEC).

The NRC 's regulations require licensees to manage and demonstrate that their liquid and gaseous effluent releases comply with prescribed dose limits to protect public health and safety and the environment throughout the operation and decommissioning of a facility. Effluent releases at IPEC are required to remain within these prescribed limits, be processed through filters, and sampled prior to any effluent being released. The NRC inspection and oversight program ensures that compliance is maintained to protect the public health and safety and the environment. To date, all releases from IPEC have been a small fraction of the allowable limits for such releases, and any future releases will also be required to comply with NRC requirements. Additionally, the NRC requires licensees to have an environmental monitoring program that includes environmental sampling and to submit an annual report to the NRC.
