Dear Kelly Allegra:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your email dated August 4, 2023 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML23234A289), in which you provided the NRC with a Motion and Resolution opposing the planned discharge of liquid effluent from Indian Point Nuclear Power Plant (Indian Point) by Holtec Decommissioning International (Holtec) into the Hudson River. I appreciate your efforts to keep the NRC informed of the activities of the New Windsor Town Board.

The controlled release of liquid effluents at nuclear power plants, within specified regulatory limits, is an activity that occurs throughout the operation and decommissioning of a facility. The NRCs regulations and licensing reviews for the facility consider such releases as part of the agencys safety and environmental determinations, ensuring that it is safe for people and the environment. The NRCs regulations and conditions in the license issued to Holtec for Indian Point require Holtec to ensure that the releases of gaseous and liquid effluents meet the applicable NRC and U.S. Environmental Protection Agency (EPA) requirements.

The NRC inspects the actions and the records of its licensees to ensure that compliance with environmental radiation standards is maintained. Further, licensees are required to have an environmental monitoring program that includes environmental sampling and to submit an annual report to the NRC. Additionally, in response to similar public concerns regarding decommissioning activities at Indian Point, the NRC has developed responses to Frequently Asked Questions about liquid discharges and other topics, which can be found at this link: https://www.nrc.gov/info-finder/reactors/ip3/faq.html.

In accordance with Title 10 of the Code of Federal Regulations 2.390, Public inspections, exemptions, requests for withholding, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS.
