EVALUATION OF THE THIRD 10-YEAR INTERVAL INSPECTION PROGRAM PLAN AND ASSOCIATED REQUESTS FOR RELIEF FOR MILLSTONE NUCLEAR POWER STATION, UNIT NO. 2 (TAC NO. M96200)

Dear Mr. Bowling:

By letter dated July 2,1996, Northeast Nuclear Energy Company (NNECO) submitted its Third 10-Year Interval inservice inspection (ISI) Program Plan, Revision 2, and associated requests for relief'or Millstone Nuclear Power Plant, Unit No. 2. Additionalinformation was provided by the licensee in its letters dated March 20,1997, and August 28,1997. By letter dated Oct:ber 31,1997, NNECO submitted an additional request to use Code Case N-509. The submitta!2 were provided in accordance with the requirements of the 1989 Edition of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code (ASME Code), except to the extent of examination of Class 1 piping welds has been determined by the Ij 1974 Edition with Addenda through Summer 1975, as permitted by Title 10 of the Code of Federal Regulations (10 CFR), Section 50.55a(b). The third 10-year interval began December 26,1996, and will end December 25, 2006.

The Technical Specifications for Millstone Nuclear Power Station, Unit No. 2, states that the ISI of the ASME Code Class 1,2, and 3 components shall be performed in accordance with Section XI of the ASME Code and applicable addenda as required by 10 CFR 50.55a(g),

except where specific written relief has been granted by the Commission pursuant to 10 CFR 50.55a(6)(g)(i). Section 50.55a(a)(3) states that altematives to the requirements of paragraph (g) may be used, when authorized by the NRC, if (i) the proposed attematives would provide an acceotable level of quality and safety or (ii) compliance with the specified requirements would result in a hardship or unusual difficulty without a compensating increase in the level of quality and safety.

The NRC staff, with technical astis.ance from its contractor, the Idaho National Engineering and Environmental Laboratory (INEEL), has reviewed and evaluated the information provided by NNECO in support of its Third 10-Year interval ISI Program Plan. Bowling Evaluation (SE), the NRC staff adopts INEEL's bases, conclusions, and recommendations presented in the enclosed Technical Evaluation Report (TER) with the exception of a typographical error as noted in the SE. Twenty relief requests or alternatives were found acceptable, one relief request was partially approved, one relief request was denied (RR-89-21), two relief requests are being reviewed independent of this effort (RR-13 and RR-14), and two requests are related to inservice testing l that are nf #'hin the scope of this review (RR-89-19 and RR-89-20). i SpecificaW, ;.,orsuant to 10 CFR 50.55a(g)(6)(i), the staff has determined that the requirements ( of the Code cited in relief requests RR-89-01, RR-89-02, RR-89-03, RR-89-06, RR-89-07, RR-89-10, RR-89-11, RR-89-12, and RR-89-14 are granted for the third 10-year inservice inspection interval. The relief granted is authorized by law and will not endanger life, property, or the common defense and security, and is otherwise in the public interest, giving due consideration to the burden upon the licensee that could result if the requirements were imposed on the facility. Pursuant to 10 CFR 50.55a(a)(3)(i), the alternatives proposed in RR-89-04 (Code Case N-521), RR-89-05, RR 89-08, RR-89-16, PA N-546, PA N-524, and PA N 535 provide an acceptable level of quality and safety and are authorized for the third 10-year inservice inspection interval. Pursuant to 10 CFR 50.55a(a)(3)(ii), the staff has determined that compliance with the Code requirements for RR-89-18 (Code Case N 547), PA N-522, PA N-416-1, and PA N-498-1 I would result in hardship or unusual difficulty without a compensating increase in the level of quality and safety. Furthermore, NNECO's proposed alternatives provide reasonable i assurance of operational readiness of the subject systems. The licensee's proposed alternatives contained in these RRs are authorized for the third 10-year inservice inspection interval. The staff also noted that NNECO is not performing inservice volumetric, surface, and visual examinations on ASME Code Class 1,2, and 3 components and their supports using sampling schedules as described in Section XI of the ASME Code and 10 CFR 50.55a(b) nor has the licensee requested relief from the schedules. NNECO must submit a request for relief if it is going to use an attemative schedule in lieu of the Code requirements. Also, in the Request for Relief, RR 89-18, NNECO listed Code Case N 547; however, the staff did not evaluate the use of the Code Case as a basis for relief, but authorized the relief based on the attemative proposed as detailed in Section 3.1.7.2 of the TER. The previous staff evaluations provided by letters dated December 7,1995, and September 13,1996, which denied the use of Code Case N-547, are still applicable. Where the use of Code Cases has been approved, they are authorized for the current interval or until such time as they are published in Regulatory Guide 1.147. At that time, NNECO is required to follow all the provisions in the Code Cases with any limitations imposed by the regulatory guide.
