The specific modifications are described below. Their basic thrust is to delete Environmental Technical Specification limitations and monitoring requirements which pertain to non-radiological liqui'd effluents and other matters within the jurisdiction of the U. S. Environmental Protection Agency (EPA) under the Federal 'rlater Pollution Control Act (FMPCA), 33 U.S.C.A. H 1251 et sece.
On March 1, 1976 the Nuclear Regulatory Covmission (NRC) issued Operating License DPR-67 for St. Lucie Unit No. 1. Appendix B to the license, Environ-mental Technical Specifications (ETS), imposes water quality effluent limitations and monitoring requirements. The National Pollutant Discharge E1imination System (NPDES) Permit issued by the EPA For St. Lucie Unit No. 1 on June 14, 1978 (NPDES No. FL0002208) also contains such conditions. In ALAB-515, however, the NRC's Atomic Safety and Licensing Appeal Board held that the NRC may not specify restrictions in excess of those imposed by EPA.
That is, the Commission may not incorporate into licenses water quality requirements above and beyond those specified in the EPA permit allowing the discharge. The existence of Appendix B effluent limitations and monitoring requirements in the St. Lucie Unit No. 1 Operating License is therefore in confli'ct with the intent of FHPCA and in contradiction with the guidance given in ALAB-515.
On the basis of the above, deletion of the following ETS requirements pertain-ing to non-radiological effluent limiting conditions and surveillance is requested.

Deletion of the Biotic monitoring requirements contained in Section 3.1.B and the Special Surveillance and Special Study Activities contained in Sections 4. 1 and 4.2 is not being requested at this time pending discussion with the EPA regarding inclusion/clarification of these requirements in the NPDES permit.
Expedited consideration of this amendment application is requested for two reasons. First, FPL plans to undertake discussions with EPA in the near future regarding modification of certain effluent limitations and monitoring requirements as they presently exist in the NPDES permit. These discussions will be conducted much more efficiently and productively if the conflict imposed by the current regulatory overlap can be eliminated. Second, FPL is currently in the process of refining the design of the circulating water system for St. Lucie Unit No. 2, now under construction. Engineering decisions and subsequent procurement and construction will depend in significant measure on the outcome of the planned discussions with EPA. For these reasons FPL requests that action on this request be completed as quickly as possible but, in any event, not later than May 15, 1979.
This proposed amendment has been reviewed by both the Company Environmental Review Group and the Company Nuclear Review Board of FPL, and they have deter-mined that the proposed amendment is administrative in nature and will result in no adverse effects to the environment. FPL has determined that this is a Class II amendment in accordance with 10 CFR 170.22 and accordingly encloses a check for one thousand two hundred dollars ($ 1,200.00).
