.Denton:0)Undersection105(c)(2)oftheAtomicEnergyActof192135(c)(2),theNRCmustforwardtotheAttorneyGeneral,orisanti-trustadvice,acopyofanoperatinglicenseapplicationiftheCommis-siondeterminesthatsuchreviewisadvisable"onthegroundthatsignificantchangesinthelicensee'sactivitiesorproposedactivitieshaveoccurredsubsequenttothepreviousreviewbytheAttorneyGeneralandCommission...inconnectionwiththeconstructionpermitforthefacility."OperatingLicenseinformationforSt.Lucie2,asrequiredby10C.F.R.550.30(d),wassubmittedtotheCommissiononMarch24,1980.Atthattime,however,informationidentifiedinRegulatoryGuide9.3asbeingpertinenttoadeterminationconcerningwhetherornotanoperatinglicense("OL")antitrustreviewwouldbeadvisable"onthegroundthatsignificantchanges...occurred'subse'uent'to'thereviousreview...at'the'construction'rmit'stae"empasisaddedcouldnotbeprovleuetotefacttatte=constructionpermit("CP")antitrustreviewhadnotyetbeencompleted.TheCPantitrustreview,infact,continuedthroughoutalmosttheentireperiodofconstructionandwasonlyrecentlycompletedwiththeissuance,onMarch24,1982,ofaMemorandumandOrderbythepresidingAtomicSafetyandLicensingBoard.Althoughitisnow,therefore,possibletoassembleandsubmittheinformationidentifiedinRegulatoryGuide9.3asbeingrelevanttothequestionofwhetherornot"significantchanges...haveoccurredsubsequenttothepreviousantitrustreviewconducted...attheconstructionpermitstage,"itisalsoclear--fromapracticalstandpoint--thatnosuch"significantchanges"couldhavedevelopedinthesixweekssincethecompletionoftheCPproceeding.Onthisbasis,andinviewoftheclosenessoftheanticipatedOctober1982operatinglicenseissuancedate,FloridaPower&LightCompany("FPL")requests,pursuantto10C.F.R.550.12,aspecificexemptionfromsomuchofSection50.30oftheCommission'sregulationsaswouldrequire:(1)furthersubmittalofantitrustinformationinconnectionwiththeissuanceofanoperatinglicensefor'St:'L'ucie2;and(2)additional,formalconsiderationofsuchinformationby"theCommissioninmakingthe"significantchanges"'Bz>Ofdetermination.Inthealternative,becausetheCommissionisalreadyawareofFPL'sactivitiesandcognizantofthefactthattherearenoslgnlflcantchanges,andsincetherelsnostatutoryrequirementforthej8205110151820505PDR*DOCK0500038mN-PDRPEOPLE...SERVINGPEOPLE

HaroldR.DentonPageTwoCommissiontomakeaformal"nosignificantchanges"determination,FPLrequestsanexemptionfromtheNRCregulatoryrequirementforsuchadetermination;.AbriefreviewoftheSt.Lucie2antitrustproceedingishelpfulinunderstandingtheuniquechronologyandcircumstancesof",the.casewhich,inturn,underliethisrequest.InMayof1973,FPLsubmittedtheanti-tpipitppiiiipiittitd:d~i2theCommission.InaccordancewithSection105(c)(1)oftheAtomicEnergyAct,42U.S.C.52135(c)(1),acopyoftheapplicationwastrans-mittedtotheAttorneyGeneralrequestinghisadviceonpossibleantitrustimplications.AlthoughtheAttorneyGeneraldidnotrecommendanantitrusthearing,suchaproceedingwascommencedinresponsetoapetitionfiledbyagroupofFloridacities.Oncecommenced,theconstructionpermitantitrustproceedingstretchedoveralmostthe.entireperiodofplantconstruction,beyondthesubmissionofOLinformation,and--asindicatedabove--wasonlyjustcompletedinlateMarchofthisyear.IncludedamongtheparticipantsweretheAttorneyGeneraltandtheNRCStaff.Asaresultoftheproceeding,whichextendedalmost5yearsbeyondtheissuanceoftheCP,allpartiesreachedsettlements.(SeegenerallyAtomicSafetyandLicensingBoardMemorandaandOrdersdatedApril24,1981andMarch24,1982.)Basedonrelatedagreements,anowner-shipinteresthasalreadybeentransferredtoOrlandoanddetailedlicenseconditions,developedinconjuctionwiththeAttorneyGeneralandNRCStaffandapprovedbytheLicensingBoardonApril24,1981,havebeenattached.(SeeConstructionPermitCPRR-144,Amendment2(Nov14,1980),andAmendment-3(May26,1981).Inaccordancewiththeseconditions,FPLhascontractedtotransferanownershipshareintheunittotheFl'oridaMunicipalPowerAgency("FMPA"),subjecttotheCommission'sapproval.g~BecauseofitsinvolvementintheantitrustprocesstheCommissionisnowinaposition,'ithouttheneedforadditionalinformationorevaluation,tomakeitsoperatinglicense"significantchanges"determination.Asaresultoftheconstructionpermitantitrustproceeding,theCommissionis--andhasbeenonacontinuingbasisoveranumberofyears--fullyappraisedofallinformationrelevanttoantitrustmatterspertainingtoFPLandOrlando,thecurrentconstructionpermitholders.InsofarasFMPA;isconcerned,weunderstandthattheCommissionwillconductan'dditionalreviewinconnec-tionwiththeapplicationforanamendmenttotheconstruction.permittoaddFMPAasapermittee."/AnapplicationforamendmentoftheconstructionpermitprovidingforthetransferofanownershipinteresttoFMPAwillbesubmittedtotheCommissioninthenearfuture.
