Mariano Lake Project, DP-44

Dear Mr. Barnhill:

The modification to DP-44, Mariano Lake Project, requested by Gulf Mineral Resources Company in your letter dated December 3, 1981 (and received December 7, 1981) is hereby approved *pursuant to Section 3-109.F.

of the New Mexico Water Quality Control Comcission Regulations. The approved modification reduces the frequency of ~onitoring the final effluent and seepage detection wells from a monthly to a quarterly basis. All other monitoring and reporting requirements remair. the same. Please be advised that approval of this modification does not relieve you of liability should your operation result in actual pollution of surface or ground waters which may be actionablP under other laws and/or regulations.

This modification approval will expire on !,ovember 21, 1983, the same date as the original discharge plan, and you should submit an application for discharge plan renewal in ample time before that date.
