This letter acknowledges receipt of your three (3) Freedom of Information Act [FOIA] requests, submitted to the U.S. Nuclear Regulatory Commission [NRC] through FOIAonline on May 13, 2022. Each of your requests seeks access to a published book or article.

As we previously informed you, the FOIA affords members of the public an avenue of access to agency records. Although the statute does not include a definition of agency records, most agencies, including the NRC, have defined the term in their implementing regulations. In the NRC's FOIA regulations, at 10 CFR 9.13, "publicly-available books, periodicals, or other publications that are owned or copyrighted by non-Federal sources" are excluded from the definition of agency record.

The three publications to which you seek access are owned by the Defense Technical Information Center [OTIS], which is part of the Department of Defense [DoD]. According to its website, if your request is in support of DoD, or U.S. Government research, you can register to use the OTIS Center and gain access to the records. If your interest in these records is not tied to governmental research, OTIS directs you to submit a FOIA request (to OTIS). Please refer to https:l/discover.dtic.millfoial for instructions on how to submit a FOIA request to the OTIS.

Since you have misdirected your request to the NRC, we are administratively closing our files on your requests.
