At approximately 50 feet before entering the protected area (PA), the drone turned west and left the OCA. The officer observed the drone for approximately 20 seconds in total before losing sight. The drone was small and had a blinking red light on it with no payload. The site entered a heightened state of awareness during the incident and returned to normal security

Event Type: Drone H.E.R.O: Thomas Kendzia Caller Affiliation: Palo Verde Security Officer noticed several drones (5 or 6) flying over the site. The drones are circling the 3 unit site inside and outside the Protected Area. The drones have flashing red and white lights and are estimated to be 200 to 300 hundred feet above the site. It was reported the drones had spotlights on while approaching the site that they turned off when they entered the Security Owner Controlled Area. Drones were first noticed at 2050 MST and are still over the site as of 214 7 MST. Security Posture was normal, which was changed to elevated when the drones were noticed. The Licensee notified one of the NRC resident inspectors.
No drones have been observed at the site since 2230 MST. Officers believe drones were over 2 feet in diameter.

- Four (4) drones were observed flying beginning at 2051 MST and continuing through the time of this report (2113 MST). As occurred last night, the drones are flying in, through, and around the owner controlled area, the security owner controlled area, and the protected area. Also, as last night, the drones are described as large with red and white flashing lights. Spotlights have not been noted tonight.
The licensee has not changed their security posture. The licensee continues to monitor the drones.
As of 0355 EDT, no drones have been observed at the site since before 0020 MST.
LLEA surveyed the area and were unable to locate drones on the ground or anyone controlling the drones.

On October l 0, NSIR staff attended a meeting of the Nuclear Security Council's (NSC)
Critical Infrastructure Security and Resilience Policy Coordinating Committee Restricted Working Group. Attendees included representatives from NSC, DOD, DOE, DOT, FAA, OHS' Cybersecurity and Infrastructure Security Agency, OOJ, and Kill]. The meeting covered recent drone flyovers at the Palo Verde Nuclear Generation Station and other sites, each agency's role, potential need for interagency assistance/coordination, and thoughts for future actions. Specific topics included current FAA and DOJ legal prohibitions and associated limitations, legislation being considered by OHS and their associated report to Congress due later this year, lack of consistency in reporting across agencies, how to assess actual threats/vulnerabilities/unacceptable consequences (while NRC remained mostly in a listening mode, staff pointed out that to date, no flyovers have exhibited a threat to a nuclear power plant), and potential assessment criteria to assist in identifying trends. The NSC is assessing the information discussed and will likely schedule future working group meetings on this topic.

Perhaps Becca's team might have a perspective on how the NRR report is characterizing the events:
- "the drones were suspected to be gathering intelligence" (I don't know where this conclusion came from)
- "armed guards, gates, fences and barriers were useless" (I can see their point in terms of non-threatening drone overflights; but I suspect that, had any drones taken hostile action, the armed guards would have been something more than "useless")

NRC documents show 57 drone fly-overs at 24 nuke facilities By Jeff Beattie With the Federal Aviation Administration considering whether to bar drones over nuclear plants, newly released Nuclear Regulatory Commission documents show that 24 U.S.
nuclear plant and spent fuel storage sites experienced 57 drone fly-overs between the end of 2014 and October 2019, with activity increasing in the later years and the agency classifying 50 as "unresolved" incidents.
The documents also reveal a particularly odd series of prolonged drone flyovers of the Palo Verde nuclear plant-the nation's biggest-in Arizona llast fall, which one NRC staffer described as a "drone-a-palooza."
All the documents were released last month by NRC based on a Freedom of Information Act (FOIA) request by Douglas Johnson, a researcher for the Scientific Coalition for UAP Studies, a group that researches UFOs and other unexplained aerospace activity.
One document, released August 5, is a listing of security incidents involving drones reported to NRC between Dec.27.2014, and Oct. 3, 2019. The list describes the date of the flyover, the affected facility and the status NRC has assigned to the incident, with little other information.
The list describes 44 drone incursions over operating nuclear plants; one flyover of the Vermont Yankee plant, which is decommissioning; and one apiece at three spent fuel storage facilities on the sites of fully decommissioned nuclear plants in California, Maine and Oregon.
It also describes a big jump in incursions during the last full year in which data was recorded-2018-when 21 incidents were reported. Ten were reported in 2017, and nine were reported over the first nine months of last year.
That pattern roughly matches findings from the North American Electric Reliability Corp.
(NERC), the nation's grid reliability watchdog, in a July annual report on the number of cybersecurity and physical security incidents reported across the U.S. grid.
In the report, NERC said one of its most serious security concerns going forward was an increase in the number of incidents involving unmanned aerial systems (UAS), or drones.
"UAS incidents were typically fly-overs where the UAS's intent could not be determined, the discovery of drones on [grid-operating] entity properties or facilities, or drones being used to conduct surveillance," NERC said.
A spokesman for NRC said the agency's staff last year assessed the drone threat to the facilities it oversees. While the agency's findings are classified, the executive summary of the assessment is not, and it says in part that "staff has determined that nuclear power
plants and...fuel cycle facilities do not have any risk-significant vulnerabilities that could be exploited using unmanned aerial vehicles and result in radiological sabotage, theft of special nuclear material (SNM), or substantial diversion of SNM.
"Similarly, the staff has determined that information gained from unmanned aerial vehicle video surveillance of an NRG-licensed facility is bounded by the type of information that could be provided by the knowledgeable insider" under nuclear plants' "design basis threat," says the summary, referring to the set of threats that plant owners must show NRC they can repel.
The NRC spokesman said nuclear plant operators do not have legal authority to shoot down drones, although the FAA in recent years expanded its long-standing guidance to aviators-and drone operators-not to fly over critical infrastructure such as nuclear power plants.
FAA protections against drone incursions at nuclear plants might soon become much tougher, after the Energy Department last fall, at the request of the nuclear industry, asked the FAA to establish restricted airspace over nuclear power plants. The FAA is reviewing that request, which would compel drone manufacturers to update their software so that drones could not operate over the nuclear facilities.
The NRC documents released under FOIA contain considerable discussion about two lengthy drone incursions over the Palo Verde, including a September 30 email among NRC staff describing the first incident, which occurred the night before.
"Officer noticed several drones (5 or 6) flying over the site," says a narrative written by NRC staff based on a call from Palo Verde security staff. "The drones are circling the [Unit 3) site inside and outside the protected area," and "have flashing red and white lights and are estimated to be 200 to 300 hundred feet above the site. It was reported the drones had spotlights on while approaching the site that they turned off when they entered the security-controlled area."
The report says drones were first noticed at 8:50 Mountain Time and were still over the site an hour later when an early report was filed.
Reacting to the report, an NRC staffer said in the email: "This one was very unusual in my experience!!! 5 or 6 drones flying over the site for over 1 1/2 hours? With lights off?"
Palo Verde saw a similar incident the following night, reporting to NRC that "four drones were observed flying beginning at 8:50 Mountain Time and continuing through the time of this report (9: 13 Mountain Time).
"As occurred last night, the drones are flying in, through, and around the owner-controlled area, the security owner-controlled area, and the protected area. Also, as [with] last night, the drones are described as large with red and white flashing lights," says the report.
Altogether, NRC says it is still investigating three incidents and four are labeled "resolved," but all other cases have been closed and classified as "unresolved."
Although it is not clear what incident NERC was referring to, the grid security watchdog highlighted a drone incident in its July annual report that sounded similar. "In one case, an entity reported several UASs flying in a stack formation over their property for over three hours two nights in a row," NERC said.
'This week has been drone-a-palooza for sure," said NRC's Office of Nuclear Security and Incident Response director in Oct. 4, 2019, email to other agency staff.
Asked to comment on the incident, a spokesperson for Palo Verde operator Arizona Public Service (APS) said the drones "never posed a threat to the safe operation of the plant," and that "potential for damage from a drone is small compared with natural hazards that the plants were built to handle, and obtaining an aerial view of a commercial nuclear facility is not considered an elevated threat to safety or security.
"That said, Palo Verde Generating Station has many layers of protection, including a
large, highly trained, highly capable security force."
Palo Verde is co-owned by seven utilities, with APS owning 29.1 percent.

Security observed three drones at one point including a drone that briefly passed over the PA.
They will be reporting each event to the HOO.
The local sheriffs office is formally investigating.

On 12/29/2017 @approximately 0600, a Plant employee reported 2 drones flying over Lot 8 area near the main warehouse. Individual states they came from the east and hovered at approximately 200 feet above the warehouse then over Lot 8. Both drones then headed east towards the hills again out of sight. Shift Manager was notified. SLO Sherriffs department notified. Security Management notified. NRC Resident notified.

- All, FYI: Diablo security spotted another drone this morning over the access road. It was not over the PA or near any sensitive areas but they will be making a voluntary HOO report for suspicious activities.
They did not change security posture.

- Mark, Another drone was seen at Diablo this morning. Security spotted it hovering over the VIS at an elevation of~ l 00-150ft. It departed to the south.
Security declared a code yellow for a short period of time, they stood down after the drone departed.
Diab lo is in the process of notifying the local sheriff's department.
They are also holding a conference call to determine if the event is reportable.
They also observed a drone over the ocean last week ( outside of OCA). In addition to the previously reported sightings over the intake structure, this is the third instance of drone activity over the site or in the vicinity of the site over the last month.
Sean Kirven (security manager) is going to call me once they complete their reportability determinations.

Talked to Sean. He's still going to give you a call. They observed a drone in the vicinity of the plant. Not over the PA. No real threat to the plant. He's still doing a report (voluntary) for information purposes. They are also considering a site wide communication and engaging the local media for some type of public service announcement.

- All, More info after a follow-up conversation with the security watch commander.
In addition to the drone spotted over the PA (which departed over the intake strncture and out to sea):
-A fishing boat offshore near Diablo spotted two drones flying overhead (reported to coast guard).
-A plant employee also reported seeing a drone on the access road about 2mi north of Avila Beach.
-California Highway Patrol has reportedly dispatched a helicopter to investigate.
A I hr security report has been made to the HOO. No change in security posture.
