Box 236 UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 August 11, 2016 Hancocks Bridge, NJ 08038 SUBJECT: SALEM NUCLEAR GENERATING STATION, UNIT NOS. 1 AND 2 -REQUEST FOR ADDITIONAL INFORMATION CONCERNING REQUEST FOR AN EXTENSION TO ENFORCEMENT GUIDANCE MEMORANDUM 12-001 (CAC NOS. MF8173 AND MF8174) Dear Mr. Sena: By letter dated July 27, 2016 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML 16209A013), PSEG Nuclear LLC (the licensee) requested an extension of the enforcement discretion authorized in the U.S. Nuclear Regulatory Commission's (NRC's) Enforcement Guidance Memorandum (EGM) 12-001, "Dispositioning Noncompliance with Administrative Controls Technical Specifications Programmatic Requirements that Extend Test Frequencies and Allow Performance of Missed Tests," dated February 24, 2012 (ADAMS Accession No. ML 11258A243), for the Salem Nuclear Generating Station, Unit Nos. 1 and 2. In EGM 12-001, the NRC stated that it will exercise enforcement discretion to allow application of surveillance requirements applicability provisions to technical specification (TS) administrative controls programs as written into plant-specific TS programs with the exceptions described in the February 24, 2012, letter. In EGM 12-001, the NRC stated that in order to continue to receive enforcement discretion, affected licensees shall submit a license amendment request (LAR) that is accepted by the NRC staff for review, within 4 months after the issuance of the notice of availability (NOA) of the model LAR, model safety evaluation, and model no-significant-hazards consideration determinations. The NOA for Technical Specifications Task Force (TSTF) Traveler TSTF-545, "TS lnservice Testing (IST) Program Removal" (ADAMS Accession No. ML 15181 A045), which includes the model LAR, safety evaluation, and no-significant-hazards consideration determinations, was issued on March 28, 2016. EGM 12-001 states that the NRC will consider extending the 4-month submittal period on a case-by-case basis, with adequate justification from the licensee. The NRC staff has determined that additional information is needed to complete its review of the request. The specific questions are found in the enclosed request for additional information. The draft questions were sent by electronic transmission on August 4, 2016, to Mr. Paul Duke of your staff. The draft questions were sent to ensure they were understandable, the regulatory basis was clear, and to determine if the information was previously docketed. On August 11, 2016, Mr. Duke indicated that the licensee will submit a response within seven buisness days of the date of this letter.

In its letter dated July 27, 2016, PSEG states that, "Due to the current level of activity associated with returning Salem, Unit No. 1, to service from extended outage," it is requesting an extension as provided for in EGM 12-001. Because of the limited level of detail provided, it is unclear to the NRC staff whether the "current level of activity" provides an adequate justification. Therefore, the NRC staff requests that PSEG provide a summary description of the "current level of activity," including a discussion of importance or safety significance, if applicable, of the "current level of activity."
