By letter dated April 9, 20 10 (ADAMS Accession Number ML101100646) with the publicly available Topical Report (ADAMS Accession Number ML101100647), Pacific Gas and Electric Company  (PG&E) requested an approval of the topical report, "Process Protection System Replacement Diversity & Defense-in-Depth Assessment," Revision 0 for the use for the Diablo Canyon Power Plant, Unit Nos. 1 and 2 (DCPP). The proposed topical report will support  PG&E's proposed replacement of the DCPP Eagle 21TM reactor trip system (RTS) and engineered safety features actuation system (ESFAS) in 2014 with a digital based instrumentation and control (I&C) replacement. The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff's acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review.
The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.
Pursuant to NRC Standard Review Plan Branch Technical Position 7-19, "Guidance for Evaluation of Diversity and Defense-in-Depth In Digital Computer-Based Instrumentation and Control System,,' Revision 5, dated March 2007, the license e requests approval of the enclosed DCPP Topical Report The NRC staff has determined that the Topical Report "Process Protection System Replacement Diversity & Defense-in-Depth Assessment" does provide technical information in sufficient detail to enable the NRC staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of PGE's request in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
