DIABLO CANYON POWER PLANT, UNIT NOS. 1 AND 2 - ACCEPTENCE REVIEW OF PROPOSED AMENDMENTS RE: REVISION TO TECHNICAL SPECIFICATIONS 3.7.5, AUXILIARY FEEDWATER SYSTEM, AND 3.7.6, CONDENSATE STORAGE TANK AND FIRE WATER STORAGE TANK (TAC NOS. MD8471 AND MD8472)

Dear Mr. Conway:

By letter dated April 3, 2008 (Agencywide Document Access and Management System (ADAMS) Accession No. ML081010207), Pacific Gas and Electric Company (PG&E, the licensee) submitted a license amendment for the Diablo Canyon Power Plant, Unit Nos. 1 and 2 (DCPP). The proposed amendment would revise Technical Specification (TS) 3.7.5, Auxiliary Feedwater System, to remove Surveillance Requirement 3.7.5.6, and revise TS 3.7.6, Condensate Storage Tank (CST) and Fire Water Storage Tank (FWST), to remove the FWST level requirements, revise the CST level requirements, and revise TS 3.7.6 to be consistent with the NUREG-1431, Standard Technical Specifications. The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff acceptance review of this amendment request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an amendment to the license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required.

This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

The NRC staff reviewed your application and by letter dated June 4, 2008 (ADAMS Accession No. ML081540540), issued an insufficient information letter. By letter dated June 20, 2008 (ADAMS Accession No. ML081820180), PG&E supplemented the license amendment request.

The NRC staff reviewed your application and its supplement and concluded that it does provide technical information in sufficient detail to enable the NRC staff to proceed with its detailed

Conway technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment.
