Dear Judge Cotter:

The San Luis Obispo Mothers for Peace and the Sierra Club request that the Nuclear Regulatory Commission engage the services of one of the national laboratories, such as Brookhaven or Sandia, to perform an indepth and independent scientific analysis of Pacific Gas and Electric Co.'s plan to rerack its spent fuel pools at the Diablo Canyon nuclear plant in order to accommodate a greatly increased amount of spent fuel.

We make the request because several factors indicate a decreasing likelihood that a permanent waste repository for commercial hi will be ready to receive waste from Diablo Canyon (gh and level radioactive America's wastes other nuclear plants) by the designated 1998 date. The U.S. Congress is reportedly prepared to cut the budget for development of one or n' ore permanent waste repositories by about 50%. Additionally, the governors of the three states - Texas, Nevada, and Washington - which have been selected as finalists in the search for a first site, have all vowed a legal fight to prevent it.

As a result, Diablo Canyon may serve as a waste repository for much longer than currently anticipated, making it far more important that we be certain that this " interim" storage solution will be a safe one. We believe that a thorough study by a national laboratory could do the necessary analyses, and its results serve as an important bases for the NRC safety hearings on the matter.
