ALLEGATIONS - WOLF CREEK (DN: STN50-4S2)

This fomards two allegations made by a former welder at the' Wolf Creek site.

Backaround The two allegations included herein stem from a previous allegation and investigation concerning falsification of a fake hanger. This was investicated by Mr. D. Driskill.

A11eoer The alleger is Mr. Dean Lingenfelter, a welder who was formerly employed by Daniel International Corporation (DIC). Mr. Lingenfelter has not requested

~ anonymity. Mr. Lingenfelter lives in a trailer near Lebo, Kahsas; his telephonenumberisl Allecations On July 25, 1952, Mr. Lingenfelter called T. Vandel, Resident Inspector at Wolf Creet, and made allegations. The first allegation was that DIC had alterec Mr. Lingenfelter's work records to indicate that his perfortnance was unsatisfactory while working as a welder for DIC at Wolf Creek. The background to this is that at some time af ter Mr. Lingenfelter was involved in the allegation and investigatior about the fabrication of a faLE hanger, he was laid off by Dit in a general reduction-in-force (RIF). At the time of the Rif, he was

told to call back in 30 days for a recall to work. Af ter the 30-day period, DIC personnel would no longer talk to him. During attempts to find other work, Mr. Lingenfelter states that he discovered that his work records had been altered by Dlt to show t.nsatisfactory perfortr.ance. The Wolf Creek resident inspector stated that to his knowledge, Mr. Linge.nfelter's work reputation at the Wolf Creek site was that of an able,' thorough, and conscientious worker.

The second allegation developed during the conversation on July 25, 1982, j between Mr. Lingenfelter and Mr. Vandel. Mr. Lingenfelter mentioned that l

talk to any NRC people," or words to that effect. The' resident inspector states that the foreman was not named.

E . H. Johnson Juli 28, 1982 Mr. Lingenfelter stated that there were two other fonner D1C welders in a similar situation. One of these was identified as Joe Fisher, but the other was not identified by name; both have apparently left the area.

  • Apparently Mr. Lingenfelter was not fired; therefore, the statutory protection normally afforded a " whistle blower" is not a consideration. His first allega-tion suggests the possibility, however, that his former employer has found a method to circumvent this protection. Certainly the timing of events is such that he imediately falls outside the 30-de cuideline used by the Department of Labor for filing complaints. Mr. Lingenfelter also stated to the resident inspector that he had already gone to another (unnamed) regulatory agency without success.
