Dear Ms. Brosius:
This is the final response to your letter dated April 13, 1984, in which you requested, pursuant to the Freedom of Information Act (F0IA), copies of three categories of records regarding the Wolf Creek nuclear power plant.
The documents listed on the enclosed Appendices A through W are responsive to your request. The documents are already available in the PDR, released in their entirety or in part, or withheld in their entirety. Documents being released in part are identified on the Appendices by asterisks. The applicable F0IA exemptions for withheld information are noted next to the document descriptions on the appendices.
Copies of documents released in whole or in part are being placed in the Nuclear Regulatory Comission (NRC) Public Document Room (PDR) in Washington, D.C., and at the two NRC Local Public Document Rooms in Kansas.
In our previous response to you dated June 10, 1985, we explained to you the procedures for reviewing or obtaining copies of the documents. Records originated by the Department of Labor (DOL) have been referred to DOL. We have requested that 00L respond directly to you regarding those records.
InformationwithheldpursuanttoExemption(5)consistsofpreliminaryadvice, opiniens, and recommendations of nembers of the NRC staff. Release of this information would tend to inhibit the frank and candid exchange of infomation in future deliberations and thus would not he in the public interest. There are no reasonably segregable factual portions because release of the facts would permit an indirect inquiry into the predecisional process of the agency. This information is being withheld from pablic disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.
Information withheld pursuant to Exemption (7)(A) consists of investigatory records compiled for law enforcement purposes, the release of which would interfere with an ongoing enforcement proceeding (see Appendices N. O, and P).
Release of this information could allow those being investigated to learn the scope, direction, and focus of investigatory efforts, and thus could possibly allow them to take action to shield potential wrongdoing or a violation of NRC requirements from investigators. This infornation is being withheld from public disclosure pursuant to Exemption (7)(A) of the FOIA (5 U.S.C. 552(b)
(7)(A)) and 10 CFR 9.5(a)(7)(i) of the Commission's regulations.

.Informati3n withheld pursuant to Exemptions (6) and (7)(C) consists of names and identifying details, the release of which would constitute a clearly unwarranted invasion of personal privacy. This information is being withheld from public disclosure pursuant to Exemptions (6) and (7)(C) of the FOIA (5 U.S.C. 552(b)(6) and (7)(C)) and 10 CFR 9.5(a)(6) and (7)(iii) of the Comission's regulations.
Infomation withheld pursuant to Exemption (7)(D) consists of the names of l
individuals and personal identifiers. Because this information consists of the identities of confidential sources, it is being withheld from public disclosure pursuant to Exemption (7)(D) of the FOIA (5 U.S.C. 552(b)(7)(D))
and 10 CFR 9.5(a)(7)(iv) of the Commission's regulations.
Pursuant to 10 CFR 9.9 and 9.15 of the Comission's regulations, it has been determined that the information withheld is exempt from production or dis-closure, and that its production or disclosure is contrary to the public interest. The persons responsible for the denial of certain portions of the documents numbered 1 through 6 on Appendix B and certain portions of the documents numbered 1, 2, 4, 5 and 6 on Appendix S, and the document identified on Appendix U are the undersigned and Mr. Robert D. Martin, Regional Adminis-trator, Region IV. The persons responsible for the denial of certain portions of the documents numbered 1, 2, 3 and 4 on Appendix L and the documents identified on Appendix T are the undersigned and Mr. James S. Taylor, Director, Office of Inspection and Enforcement. The person responsible for the denial of certain portions of the documents numbered 1 through 6 on Appendix 8 the documents identified on Appendices C through K and M through R certain por-tions of the documents numbered I, 3 and 4 on Appendix L, and documents 1, 2 and 4 identified on Appendix 5 is Mr. Ben B. Hayes, Director, Office of Investigations.
The denials by Messrs. Martin, Taylor and myself may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an
" Appeal from an Initial F0IA Decision." The denial by Mr. Hayes may be appealed within 30 days to the Comission and should be addressed to the Secretary of the Commission.
