ALLEGED DISCRIMINATORY PERSONNEL PRACTICES AT WOLF CREEK Q4-82-0012/4-82-0008 I

1.

On July 28, 1982, Mr. Dean Lingenfelter, a fonner Daniel International

Corporation (DIC), ggr at Wolf Creek contacted NRC Region IV and related two allegations to 1r. w. C. Seidle.

As background, it is noted that Lingenfelter was the a11eger in an NRC Region IV Investigation, 50-482/81-07, which concerned the willful duplication of a safety-related pipe hanger from nonsafety-related material.

On August 2,1982, Lingenfelter was interviewed telephonically by the reporting investigat'or and Mr. 'D. P. Tomlinson, Region IV.

Lingenfelter stated that subsequent to investigation 81-07, he was assigned to work for a fomman named 011.ie Franks avho watched him very closely. He stated that on occasions Franks mould " yell and cuss" et him, in the pnsence of other workers, with'trdt apparent justification.

Lingenfelter.' stated this treatment occurred on several occ,asions Between the sumer of 1981 until January 13, 1982, ap which time he ;(Lingenfelterl'as told By Franks 'at the time he was was laid c.ff during a reduction-of-

stated that in about mid-February 1982, he began contacting Franks and making inquiries conceming being rehired. He stated he was repeatedly told they were not rehiring.

This refers to the investigation conducted by Messrs. H. B. Griffin and D. D.

Driskill of the Office of Investigations during the period August 2, 1982, to January 10, 1983, of allegations received by the NRC concerning activities authorized by NRC Construction Permit CPPR 147.

The allegations investigated and the summary of our findings are discussed in the enclosed investigation report.

Our investigation. determined that the allegations were not substantiated and that no violation of NRC regulations occurred.

We are considering this matter to be closed.

In accordance with 10 CFR 2.790(a), a copy of this letter and the enclosure will be placed in the NRC Public Document Room unless you notify this office, by telephone, within 10 days of the date of this letter and submit written application to withhold information contained therein within 30 days of the date of this letter.

Such application must be consistent with the require-ments of 2.790(b)(1).
