SUBJECT:
INVESTIGATION OF ALLEGED DISCRIMINATORY PERSONNEL PRACTICES AT THE WOLF CREEK NUCLEAR GENERATING STATION Attached is the Office of Investigations' Report of Investigation concerning the above matter.
The investigation was conducted to determine if Daniel International Corpor-ation management unlawfully discriminated against and/or terminated an employee because he had assisted in an NRC investigation and instructed personnel not.to talk to the NRC. This complaint was brought to the NRC by the terminated employee.
In our view, the information developed by the investigation does not support the former employee's charges.
Interviews of co-workers, including one of three individuals identified as a corroborative witness by the former employee, and Daniel supervisors depicted a situation wherein the former employee's work performance and " attitude" had deteriorated during the period prior to his termination. The witnesses' testimony was generally uniform that"they were not advised not to talk to the NRC. We conclude that the weight of the evidence is contrary to the allegations.
Accordingly, this investigation is closed.
