REPORT ON GORE-MBEKI BINATIONAL COMMISSION MEETING (JULY 19, 1996)

The second meeting of the Gore-Mbeki Binational Commission was held July 19-23, 1996 in Washington. I attended the Sustainable Energy Committee meeting on July 19. The Progress Report II of the Committee is at attachment 1, and the matrix of activities (current through July 18, 1996) is at attachment 2.

Although a date was not set, both governments favored holding a third GMBC in about six months.

After consulting with NRC, in the first Binational Commission meeting in December 1995,the Department of Energy (DOE) proposed matrix items in reactor  ;

annealing and nuclear safety. Under the former, the South African regulatory l organization, the Council on Nuclear Safety (CNS), was invited to participate '

in the DOE Annealing Demonstration Program (see pages 30-31 of attachment 1).

Under the latter, DOE proposed to work with South African legislators in drafting new nuclear safety and npclear waste legislation. DOE also proposed to fund and organize a "U.S.-South Africa Conference on the Peaceful Uses of l Nuclear Energy," which would address nonproliferation policy, export controls, l technical exchanges, and nuclear safety (see pages 28-29 of attachment 1).

DOE has requested that NRC provide a presentation on "the regulatory process" '

in the U.S. Each of these proposals was well received by the South African side.

During my presentation before the Sustainable Energy Committee of the second i Binational Commission meeting I requested DOE and South Africa expand the high-level dialogue on nuclear safety topics as a follow-on to the NRC-CNS regulatory information exchange agreement by adding an item on strengthening South African nuclear regulation, and an item on South African participation in international nuclear safety research, both subject to identifying sources of funding. I also offered for consideration NRC help in the review of South African nuclear legislation, including meeting in the U.S. with South African legislators to discuss NRC's relationship with its Congressional oversight committees. (This is similar to our recent role in assisting Ukrainian legislators using USIA funding to visit the U.S. to learn more about the legislative process concerning nuclear energy matters.) Finally, I noted NRC's intent to participate in the Peaceful Uses Conference, as requested.

Both South African Minister Designee Maduna of the Department of Mineral and Energy Affairs and Department of Energy Secretary O' Leary welcomed these initiatives, and agreed to add them to the Binational Commission's Commitments Matrix. (Note: As of this date, DOE has not produced the final Report of either the Sustainable Energy Committee or of the Gore-Mbeki Binational 1r) v/

MITI and NRC have a strong history of nuclear safety cooperation. Although our bilateral arrangement has been expired for several years, our cooperation has continued in good faith as renewal of the arrangement was negotiated. My staff advises me -that agreement on a final text is very close. In October, I will make the keynote address to the Pacific Basin Nuclear Conference in Kobe.

I hope the arrangement will be ready by then. In this event, I would plan to visit Tokyo to sign it and exchange views with you and other Japanese colleagues on current nuclear safety issues.
