Request for Exemption from Annual Radiological Emergency Preparedness Exercise for the State of Delaware and Local Governments Around the Salem Generating Station The State of Delaware and Kent and New Castle Counties are scheduled for a joint exercise of offsite radiological emergency preparedness at the Salem Generating Station in October of 1984. Attached is a request from the State of Delaware that participation by the affected local governments and the State not be required for this exercise. Also attached is a memorandum from the Federal Emergency Management Agency (FEMA) Region III concurring with the State's request for exemption. The results of the previous exercise did not necessitate any requirement for a remedial exercise. Deficiencies identified have been corrected or are scheduled to be corrected.

We have advised FEMA Region 111 that since the State of Delaware and local governments within the 10-mile Emergency Planning Zone of the Salem Generating Station are eligible to go to a biennial exercise frequency in accordance with 44 CFR 350, they are excused from participation in the annual exercise scheduled for October 1984. Therefore, we would support a Nuclear Regulatory Commission exemption from the 10 CFR 50, Appendix E, Section IV.F.1., annual exercise requirement for State and local governments in this instance in the event such an exemption is requested by the Public Service Electric and Gas Company, the licensee of the Salem Generating Station.

Request for Exemption from Annual Radiological Emergency Preparedness Exercise for the State of Delaware and Local Governments Around the Salem Generating Station This memorandum is in response to your April 12, 1984, memorandum concerning an exemption for the State of Delaware and local governments around the Salem Generating Station from participating in the annual exercise scheduled for October 1984.

As a result of the participation of these jurisdictions in a full-scale (now referred to as full-participation) exercise on October 26, 1983, which occurred between October 1982 and the present, they are eligible to go to a biennial frequency. This means that the State and local jurisdictions will be required to participate in an exercise with the Salem Generating Station within two years of the date of the last full-participation exercise. .

Additionally, the results of the October 26, 1983 exercise did not necessitate any requirements for a remedial exercise.

We have advised the Nuclear Regulatory Commission (NRC) that the State of Delaware and local governments within the 10-Jnile Emergency Planning Zone of the Salem Generating Station are not required to participate in the Salem Generating Station exercise scheduled for October 1984, based on the provisions of 44 CFR 350.9. We also expressed Federal Emergency Management Agency support of any licensee request for exemption from NRC's rule 10 CFR 50, Appendix E.Section IV F.1., requiring annual exercise participation by State and local governments.

We will keep you advised of any action by NRC on this matter.

Exempting Delaware from 1984 Salem REP Exercise Attached is a request from Delaware for exemption from participating in the 1984 Salem REP exercise. This exercise was originally scheduled back in 1983, at which time FEMA required annual participation. The State of Delaware and Counties of Kent and New Castle participated fully during the October 26, 1983 exercise, and under the present FEMA regulations requiring biennial exercise participation, we believe these jurisdictions are not required to participate in a Salem REP exercise in 1984. We recommend that this exemption be granted.
