Dear Mr. Regan:

This letter is in response to your letter of October 31, 1979 and reflects agreements reached at a January 7, 1980 meeting between the NRC, National Marine Fisheries Service (NMFS}, Fish and Wildlife Service, EPA, New Jersey Department of Environmental Protection, and the Public Service Electric and Gas Company and its consultants, concerning the possible taking of shortnose sturgeon, Acipenser brevirostrum, at the PSE&G Salem Generating Station and the obligation of the NRC and EPA, as federal licensing agencies for that facility, to fulfill certain consultation functions involving NMFS under the Endangered Species Act.

By this letter, a copy of which is being transmitted to the Regional Director of the NMFS, and through an under-standing reached between EPA staff, NRC staff, and NMFS staff during the January 7, 1980 meeting concerning entrain-ment and impingement aspects of the present cooling water intake system at the Salem facility, EPA joins with NRC in its consultation with NMFS prior to agency action, as required by 16 u.s.c. §1536.

EPA understands that NRC will act as lead agency in the consultation with NMFS concerning the Salem facility. Should

  • additional monitoring information be required to fulfill the NRC/EPA consultation function, EPA will attempt to secure such information through appropriately fashioned monitoring provisions in the Salem NPDES permit.
