REVISED REQUEST FOR AMENDMENT FACILITY - OPERATING LICENSE NPF-57 HOPE CREEK GENERATING STATION DOCKET NO. 50-354 Public Service Electric and Gas Company (PSE&G) hereby transmits e revised application to amend Appendix A of Facility Operating License No. NPF-57 in accordance with 10CFR50.90 and applications for specific exemptions from 10CFR50, Appendix J and from 10CFR100, Appendix A.

This revised amendment request does not change our April 3, 1991 submittal in that it continues to provide for an increase in the allowable leak rate for the main steam isolation valves (MSIVs),

and would continue to delete the MSIV Sealing System. Also, the exemption requests, as before, would exclude main steam isolation valve leakage from.the acceptance criteria of 10CFR50, Appendix J, Paragraphs III. A.5(b) (1) and III. A. 5(b) (2) for overall integrated containment leakage rate measurements and would exclude main steam piping downstream of the MSIVs and the main condenser from the seismic requirements in 10CFR100 Appendix A.

In support of the above requests, PSE&G has enclosed the following for the Nuclear Regulatory Commission's review:

1) Application for Amendment to the Facility Operating License -

Technical Specifications change description, supporting information and analyses for the changes, the basis for a no significant hazards consideration determination and marked-up Technical Specification pages.

2) Application for specific exemption from 10CFR50, Appendix J; and supporting information and justification for the exemption request that, pursuant to 10CFR50.12(a), demonstrates that the request is authorized by law, will not present an undue risk to the public health and safety, and is consistent with the common defense and security. Furthermore, special circumstances are present which warrant issuance of this exemption request.
3) Application for specific exemption from 10CFR100, Appendix A; and supporting information and justification for the exemption request. Although PSE&G realizes that there is no provision in 10CFR100 for exemption, the Nuclear Regulatory Commirsion has the authority to grant this exemption. .This exemption would not present an undue risk to the public health and safety, and is consictent with the common defense and security. Furthermore, each application presents special circumstances which warrant issuance of that requested exemption.

These proposed changes are supported by BWR Owners' Group (BWROG) work. The BWROG formed a MSIV Leakage Committee in 1982 in response to Genric Issue C-8, "MSIV Leakage and LCS Failure".

Generic Issuo C-8 addressed the safety concerns that reported MSIV leakages are too high and that Leakage control Systems will not function at high MSIV leakages. Based upon the extensive, ongoing work performed by the BWROG to support resolution of the Generic Issue, the BWROG has developed the technical justification for the proposed Technical Specifications changes and associated exemption requests. General Electric report, NEDC-31858P, Rev. 1, attached, describes the safety benefits and provides justit'ication for the proposed changes.

Pursuant to the requirements of 10CFR50.91(b) (1) , PSE&G has provided a copy of this request to the State of New Jersey.

Upon NRC approval of the proposed changes, PSE&G requests that the amendment and exemptions be made effective on the date of issuance but, to allow for related administrative activitics, that the amendment be made inplementable within thirty days of startup following the outage during which the physical plant modifications described in this request are completed.

Due to our design change preparation and outage planning needs, the timing of the NRC's review and approval of the requested amendment and exemptions will significantly affect the scheduling of the above plant modifications. Since the NRC staff's current projections call for at least a nine month review, PSE&G expects to implement the necessary physical plant modifications during the fifth refueling outage - prescotly scheduled for March, 1994.
