By order of December 16, 1983, this Board has requested responses to a letter dated December 9, 1983 from counsel for Joint Intervenors to this Board regarding the so-called " Stokes affidavit" and an NRC Staff investigation of a " number of allegations about the design of Diablo Canyon." Specifically the letter requests three things:

(1) a Board Notification of the Stokes affidavit, (2) an order from this Board directing the staff to provide copies of all reports or memos, interim or final, arising out of the current inspection of " design-related allegations," and (3) that all parties be given a " timely opportunity" to comment on the Stokes affidavit and Staff inspection.

As respects (1) and (3) above, we believe both of these matters are covered by existing regulations. The applicant or licensee is not responsible for making Board Notifications and 8312270136 831221 PDR ADOCK 05000275 G PDR

As far as a " timely opportunity" to comment is concerned, the regulations provide ample opportunity for the Joint Intervenors to bring whatever matters they desire before both this Board and the Commission.

As respects the second request of Joint Intervenors, the licensee believes that the inspection dealt with numerous allegations received by the NRC from various sources during the past 60 days. While the licensee has not been afforded the opportunity to review or see most of the allegations, it is our belief, based on the nature of the inspection and those allegations we have seen, that the vast majority of these allegations do not deal with design quality assurance. The licensee has not seen any reports or memos, interim or final, concerning the inspection and presumably the NRC Staf# will make public their reports when they are available.
