50-322) - Status of MHB Report on County Contentions

Dear Mr. Hoefling:

1 This letter is to advise as to the status of a report to be prepared by the County's consultant in this proceeding, MHB Technical Associates, which report is to particularize the County's admitted contentions in this l proceeding and to provide the basis for those contentions.

I refer you to a September 19, 1978 pleading entitled

" Motion for Extension of Time to Respond ~to (Applicant's)

Interrogatories" in which the status of the MHB report is reviewed. Since the time of the submission of that pleading, I have been advised by Counsel to the Suffolk County Legisla-ture that approval of the MHB proposal will have to be accomplished via submission of a resolution to be voted on by the full Legislature. I have been informed that an appro-priate resolution calling for such approval will be sub-mitted to the Legislature for their disposition on Tuesday, October 10, 1978. Unfortunately this procedure (and assuming that the Legislature acts favorably on the reso-lution) will result in some further delay of the MHB report.

I contacted Mr. Dale Bridenbaugh of MHB and he informs me that he will be participating as technical consul-tant in the Black Fox hearings (Application of Public Service of Oklahoma, Docket Nos. 55-556 & 557) during the week of October 9 - 13 If the Black Fox hearings proceed as presently scheduled Mr. Bridenbaugh indicated that he would have available the weeks of October 16 - 20 and 23 - 27 to work on the County report. His associate, Mr. Richard Hubbard, will have time available during the weeks of October 9 - 13 and 23 - 27 to work on this report. Thus, if the legislature approves the MHB proposal, which appears quite likely in view of their previous resolution calling for MHB to finalize the County contention, the report should be completed not later than October 27, 1978.

I am sending this letter to all parties to this pro-ceeding so that the Hearing Board and the Applicant will be advised of the further slippage of the probable completion date of MHB's report.
