Dear Chairman Miller:

At the September 15, 1980 status hearing in the above-referenced proceedings, Mr. James R. Choukas-Bradley, of this law firm, addressed the Atomic Safety and Licensing Board concerning the Petition of the Border Cooperatives for Leave to Intervene Out of Time. Prior to responding to the Board's questions, Mr.

Choukas-Bradley advised that he had not yet received the results of the District of Columbia Bar Exam and had not yet been admitted to the practice of law as an attorney. In the course of the ensuing discussion, it was requested that the record be supplemented with a confirming statement that Mr. Choukas-Bradley did have Authorization to act as a representative for the Border Cooperatives. As attorney of record for the Border Cooperatives I would like to confirm that Mr. Choukas-Bradley was authcrized to express the position of this I law reviewed have firm on behalf the of the Border transcript of.the Cooperatives. Furthermore, September 15, 1980 status conference, and the representations made by Mr. Choukas-Bradley at that time do accurately reflect the Border Cooperatives' position. .

Marshall Miller September 24,~1980 Page two I would like the record to be clear, however, that neither I nor Mr. Choukas-Bradley anticipated that the matter of the Border Cooperatives' intervention would be taken up at the September 15, 1980 status hearing. To the contrary, I personally telephoned your office on Friday, September 12, 1980, to ascertain whether the subject of the Border Cooperatives' intervention would be a topic of the discussion, and was advised that it would not. It was only after being so advised by a secretary that Mr.

Choukas-Bradley was designated to monitor the proceedings.
