Dear Mr. Wolfe:

Last week I received a telephone call frein your office, seeking my, comments on a proposed schedule for resolving Houston's Motion l In Limine to Exclude the Proffered Expert Testimony of Mr. Carl Stover. In its cover letter accompanying that motion, Houston had requested resolution in an expedited fashion. Since then, however, settlement discussions between the Department, Staff and Houston (and others) have continued on a sustained and time-consuming basis.

On Monday, April 28, 1980 I telephoned your office to advise that counsel for Houston and the Department had conferred and had agreed that in order to facilitate these settlement discussions, counsel would request that responses on the matter be deferred until after May 9, 1980, on which date the parties have been directed by the Board to report upon the status of the settlement discussions.

I communicated this agreement between counsel to your secretary orally.on Monday, and in the interest of informing the record, I have forwarded this confirmatory letter.
