Dear Mr. Saltzman:

This is in reply to your letter of October 10, 1979, submitting Amendment No. 12 to Indemnity Agreement No. D-9 between the National Bureau of Standards and the Nuclear Regulatory Commission for our review and acceptance. The amendment modifies the definition of "in the course of transportation" to include transportation outside the United States, and reflects the amcndment to 10 CFR Part 140, " Financial Protection Requirements and Indemnity Agreements,"

published by the Commission and effective on May 1, 1977.

Pursuant to your request, Indemnity Agreement No. D-9, dated January 3, 1966, as amended by Amendment No. 12 thereto and effective as of May 1, 1977, has been reviewed and is accepted by the National Bureau of Standards. A signed copy of the Amendment is enclosed.
