Dear Mr. Hendrie:

Re: St. Lucie Unit 1, Turkey Point Units 3 & 4 Docket Nos. 50-335, 50-250, 50-251 Exemption Request from Certain Requirements of 10 CFR 50, A endix E, Para ra h IV.D.3 Florida Power & Light Company, in accordance with 10 CFR 50.12(a), hereby respectfully requests the Nuclear Regulatory Commission to exempt St. Lucie Unit 1 and Turkey Point Units 3 & 4 from certain requirements set out in 10 CFR 50 Appendix E, paragraph IV.D.3.

Specifically FPL requests that we be granted an extension for the requirement to establish by July 1, 1981 the administrative and physical means for alerting and providing prompt instructions to the public within the plume exposure pathway EPZ within about 15 minutes.

It is requested that we be granted an extension of six months for this requirement which will not endanger life or property or the common defense and security.

The enclosure provides a detailed summary of our present status and best efforts in our progress towards meeting this requirement.

Our schedule for delivery and installation of the equipment is subject to the uncertainties associated with the ongoing tasks listed in section B of the enclosure; however, we expect to have the systems operational at Turkey Point and St. Lucie by December 31, 1981.

A. Summary of Past Events and Efforts that have dictated our present status with respect to the Public Warning System:

(1) August 19, 1980 Federal Register Notice on Final Emergency Planning Rule including Public Warning System, (10 CFR 50, Appendix E, IV.D.3.).

(2) Sept. 22, 1980 FPL decision made to obtain a consultant to study public warning system requirement and recommend a course of action.

(3) Oct. 31, 1980 Wyle Labs selected as the consultant to study the requirement for a public warning system.

(4) Nov. 3, 1980 Final Emergency Planning Rule issued and refers to NUREG-0654 for guidance.

(5) December, 1980 Revision 1 of NUREG-0654 received, Appendix 2 revised relating to public warning system.

(6) Jan. 22, 1981 Preliminary Wyle Labs reports received.

(7) Jan. 30, 1981 FPL meeting in Tallahassee with State officials on funding for warning system.

(8) Feb. 12, 1981 FPL meeting in Tallahassee with State officials on funding for warning system.

(9) March 3, 1981 Revised specifications for sirens received from Wyle Labs.

(10) March 10, 1981 Meeting with counties on funding St. Lucie, Hartin.

(11) March 12, 1981 Meeting with counties on funding Dade, Monroe.

(12) March 26, 1981 Emergency Planning Meeting in GO-NRC/FEMA/State/County/FPL. Resolved some differences with NRC. FPL management pledges to provide funds for Alert System.

(13) May 12, 1981 Poles for sirens ordered.

(14) Hay 20, 1981. 70 sirens on order from Whelen Engineering.

(15) June 1, 1981 Final siren sites selected based on audio engineering.

(16) June 24, 1981 Grant agreement signed with Florida Department of Veterans and Community Affairs on funding, ownership, and maintenance of Alert System.

(17) July 1, 1981 - NRC deadline for operability of public warning system.

B. At present, PPL is engaged in the following tasks with regard to the Alert System:

The securing of permits/easements with D.O.T., 4 counties, 5 cities, and 2 other utilities.

Obtaining FCC licenses for actuation of system; requires verification of frequencies County/State/FCC agreements.

On the basis of informal agreements, FPL is in the process of issuing Purchase Orders for transmitters and repeaters.

Salt spray testing and wind tunnel testing in progress on the siren equipment.
