MID-CYCLE ASSESSMENT LETTER FOR ST. LUCIE NUCLEAR PLANT UNIT 1 AND UNIT 2 (NRC INSPECTION REPORT 05000335/2012006 AND 05000389/2012006)

Dear Mr. Nazar:

On August 15, 2012, the NRC completed its mid-cycle performance review of St. Lucie Nuclear Plant Unit 1 and Unit 2. The NRC reviewed the most recent quarterly performance indicators in addition to inspection results and enforcement actions from July 1, 2011, through June 30, 2012. This letter informs you of the NRCs assessment of your facility during this period and its plans for future inspections at your facility.

The NRC determined that overall, St. Lucie Units 1 and 2 operated in a manner that preserved public health and safety and met all cornerstone objectives. The NRC determined that performance at St. Lucie Nuclear Plant Units 1 and 2 for the third and fourth quarters of 2011 were within the Licensee Response Column of the NRCs Reactor Oversight Process (ROP)

Action Matrix because all inspection findings had very low (Green) safety significance and all performance indicators indicated performance was within the nominal, expected range (Green).

While performance at St. Lucie Unit 2 remained within the Licensee Response Column for the entire assessment period, performance at St. Lucie Unit 1 was in the Degraded Cornerstone Column of the ROP Action Matrix for the first and second quarters of 2012. As noted in the NRCs assessment follow-up letter dated May 10, 2012, (ML12132A352) St. Lucie Unit 1 performance indicators for Unplanned Scrams per 7000 Critical Hours and Unplanned Scrams with Complications both crossed the green-to-white threshold for the first quarter of 2012, and remained unchanged during the following quarter.

The NRC plans to conduct ROP baseline inspections at both units. Additionally, to review the actions taken to address the performance issues on Unit 1, the NRC plans to conduct a supplemental inspection on Unit 1 in accordance with Inspection Procedure 95002, Supplemental Inspection for One Degraded Cornerstone or Any Three White Inputs in a Strategic Performance Area. This inspection will be conducted to provide assurance that the root and contributing causes for these issues, both independently and collectively, are identified and understood, to determine if any safety culture components caused or contributed to the

M. Nazar 2 performance issues, and to ensure the licensees corrective actions for risk-significant performance issues are sufficient to address the root and contributing causes and prevent recurrence.

The NRC also plans on conducting Inspection Procedure 71004, Power Uprate, and initial operator licensing examinations.

The enclosed inspection plan lists the inspections scheduled through December 31, 2013.

Routine inspections performed by resident inspectors are not included in the inspection plan. In addition to the baseline inspections, consistent with the Agencys actions related to Fukushima, the NRC will perform TI-187, Inspection of Near-Term Task Force Recommendation 2.3 Flooding Walkdowns, and TI-188, Inspection of Near-Term Task Force Recommendation 2.3 Seismic Walkdowns. The inspections listed during the last nine months of the inspection plan are tentative and may be revised at the end-of-cycle performance review. The NRC provides the inspection plan to allow for the resolution of any scheduling conflicts and personnel availability issues. The NRC will contact you as soon as possible to discuss changes to the inspection plan should circumstances warrant any changes. This inspection plan does not include security related inspections, which will be sent via separate, non-publicly available correspondence.

In accordance with 10 CFR 2.390 of the NRC=s ARules of Practice,@ a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
