SUMMARY

OF THE MAY 24, 2005, PUBLIC MEETING TO DISCUSS DAVIS-BESSE TRANSITION FROM THE MANUAL CHAPTER 0350 OVERSIGHT PROCESS TO THE NORMAL REACTOR OVERSIGHT PROCESS (ROP)

On May 24, 2005, the Nuclear Regulatory Commission (NRC) held a public meeting at the Camp Perry Clubhouse in Port Clinton, Ohio. The meeting was between the NRC Davis-Besse Oversight Panel and FirstEnergy Nuclear Operating Company (FENOC) to discuss licensee performance and planned transition of the facility from the Manual Chapter 0350 oversight process to the Reactor Oversight Process (ROP). The NRC began the meeting by announcing that Davis-Besse will transition from oversight under the IMC 0350 process to the Reactor Oversight Process, effective July 1, 2005. The Agency briefly described the assessment process on which this decision was based. The NRC provided a brief overview of the Reactor Oversight Process and informed the licensee that, based on their current level of performance, they would be placed in the Regulatory Response column of the Reactor Oversight Process Action Matrix. Also, the licensee was informed that inspection activities to ensure compliance with the requirements of the March 8, 2004, Confirmatory Order and in the area of Problem Identification and Resolution would be performed in addition to the inspections that are required by a facility that is in the Regulatory Response Column of the Action Matrix. The NRC concluded their initial remarks by outlining upcoming activities through the end of CY2006.

The licensee began their presentation by stating their desired outcomes for the meeting were:

demonstrate Davis-Besses operations continue to be safe and conservative; discuss site activities since that last public meeting; and status the improvement initiatives and Confirmatory Order Independent Assessments. Key topics that were discussed included: Plant Performance/Assessments; Operational Improvement Plan and Backlog Reduction; Safety Culture and Safety Conscious Work Environment; and Oversights Perspective. The closing message from the licensee was that Davis-Besse personnel were people with a strong safety focus delivering top fleet operating performance.

FirstEnergy Nuclear Operating Company Following the licensees presentation, the NRC provided the public with the opportunity to provide comments or ask questions. After two brief statement by local county officials, the meeting was concluded.
