The U.S. Nuclear Regulatory Commission (NRC or the staff) and representatives of FirstEnergy Nuclear Operating Company (FENOC or the applicant) held a telephone conference call on January 23, 2013, to discuss and clarify the staff's requests for additional information concerning the Davis-Besse Nuclear Power Station, Unit 1, license renewal application. provides a listing of the participants and Enciosure 2 contains a summary of the staff discussion with the applicant. A brief description on the status of the items is also included.

OF TELEPHONE CONFERENCE CALL DAVIS-BESSE NUCLEAR POWER STATION, UNIT 1 LICENSE RENEWAL APPLICATION January 23,2013 The U.S. Nuclear Regulatory Commission (NRC or the staff) and representatives of FirstEnergy Nuclear Operating Company (FENOC or the applicant) held a telephone conference call on January 23, 2013, to further discuss and clarify request for additional information, RAI B.2.43-3a, concerning the Davis-Besse Nuclear Power Station. Unit 1 (Davis-Besse),

license renewal application. This telephone conference call is a continuation of a previous telephone conference call held on January 16, 2013, (ML13051A068), in which the staff provided clarification to FENOC regarding RAls B.2.43-2a and B.2.43-3a, issued by letter dated January 4,2013 (ML12355A184).

RAI B.2.43-3a Discussion: This RAI questions why other structures within the scope of license renewal were not included within the scope of the shield building aging management program (AMP) and whether structural coatings for the other structures are included in the scope of license renewal.

During the call, the staff informed FENOC that it had decided not to withdraw the RAI. as discussed on an earlier conference call. because the information being sought was not on the docket. Specifically, the staff was able to locate information about safety-related structures that were within the scope of license renewal on the docket. but not information concerning non safety-related structures within the scope of license renewal. Additionally, the staff stated that RAI 8.2.43-3a is not about aging mechanisms of the shield building cracks, since the cause of the cracks was not related to aging. The staff clarified that the request is for FENOC to provide more detail on why other structures within the scope of license renewal. especially those structures that are uncoated. are not included in the scope of the plant-specific shield building AMP. FENOC understood the staffs request and stated that in its response it will address the other structures within the scope of license renewal.

With regards to the coating portion of the RAI. the staff further clarified that it was associated with the structure monitoring program AMP-not the shield building AMP. The staff stated that the wording of license renewal commitments made by FENOC regarding the use of American Concrete Institute (ACI) Report 349.3R, "Evaluation of Existing Nuclear Safety-Related Concrete Structures:'for the inspection of coatings appeared inconsistent with a response to an earlier RAI..

The staff stated that. instead of addressing the RAI as written, FENOC should respond to RAI B.2.43-3a by providing a response consistent with the clarifications provided during this telephone conference call. The staff and FENOC agreed to a revised due date for the submittal of FENOC responses to the RAls to February 28, 2013.

Action: FENOC will provide a response to the RAls by February 28.2013. As part of its response it may reference this summary, which documents the staffs clarification of the RAI during the telephone conference call and a separate summary of a previous telephone conference call held on January 16, 2013.
