SUMMARY

OF JANUARY 5, 2016, MEETING WITH FIRSTENERGY NUCLEAR OPERATING COMPANY ON ITS PLANNED LICENSE AMENDMENT REQUEST TO REVISE THE EMERGENCY ACTION LEVEL SCHEME AT DAVIS-BESSE NUCLEAR POWER STATION, UNIT NO. 1 (CAC NO. MF7156)

On January 5, 2016, a Category 1 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of FirstEnergy Nuclear Operating Company (FENOC, the licensee) via teleconference. The purpose of the meeting was to discuss FENOC's planned license amendment request to revise the emergency action level (EAL) scheme for the Davis-Besse Nuclear Power Station (Davis-Besse), Unit No. 1. The meeting notice and agenda, dated December 14, 2015, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML15348A387. A list of attendees is enclosed.

The licensee stated that its proposed amendment is based on the Nuclear Energy Institute (NEI) 99-01, Revision 6, "Development of Emergency Action Levels for Non-Passive Reactors," dated November 2012 (ADAMS Accession No. ML12326A805). NEI 99-01, Revision 6, was endorsed by the NRC by letter dated March 28, 2013 (ADAMS Accession No. ML13091A209). The licensee stated its current EAL scheme is based on NEI 99-01, Revision 5.

The licensee said it planned to submit the application on February 19, 2016, and would ask for approval within 12 months following the submittal. The licensee stated that the contents of the application would include: plain copy of the EAL basis, redline copy of the EAL basis, comparison matrix, EAL calculations, and definitions reviewed against NEI 99-01, Revision 6.

Following an NRC question, the licensee stated that it would site the appropriate regulatory basis in Appendix E to Title 1O of the Code of Federal Regulations (10 CFR) Part 50. In addition, the licensee also stated that using the standards in 10 CFR 50.92 there were no significant hazards considerations.

The licensee stated that its proposed EAL scheme will have some differences with the NEI 99-01, Revision 6, guidelines, but there are no deviations. This determination was made using the guidance and definitions in Supplement 2 (ADAMS Accession No. ML051450482) to the NRC Regulatory Issue Summary 2003-18, "Use of Nuclear Energy Institute (NEI) 99-01,

'Methodology for Development of Emergency Action Levels,' Revision 4, Dated January 2003."

The licensee stated that the EAL scheme change would not change the license, technical specifications, or updated final safety analysis report for Davis-Besse. In addition, there would not be any changes to systems, structures, or components. The change would also not require any exceptions, exemptions, or reliefs from current requirements.

The NRC staff stated that the proposed EAL scheme should not include any safeguards information. The licensee confirmed it would not. The staff asked if the new spent fuel pool instrumentation, required by a post-Fukushima order, had been installed at Davis-Besse and would be included as part of the proposed EAL scheme. The licensee confirmed that the instrument has been installed and this will be reflected in the proposed EAL scheme.

Based on the discussion, the NRC staff stated that the application would likely be accepted for review since it covered all the expected topics.

The NRC staff noted that a similar amendment for FENOC's Perry Nuclear Power Plant was currently under review. The staff asked if FENOC was planning on also submitting a similar amendment for Beaver Valley Power Station, Unit Nos. 1 and 2. The licensee stated it was planning to request an EAL scheme change for Beaver Valley. The staff encouraged the licensee to hold a pre-application phone call for the Beaver Valley application as well.

Members of the public were in attendance, and several provided comments at the end of the meeting. Public Meeting Feedback forms were not received. Several comments concerned the ability to evacuate local populations, particularly the nearby islands during the summer months.

Additional comments concerned the distribution of potassium iodide (Kl). The NRC staff informed the commenters that the proposed changes are related to the EAL scheme which is used to ensure that the site can notify appropriate officials within 15 minutes of an event. Thus, the proposed change would not impact the offsite response. The staff also noted that the Federal Emergency Management Agency (FEMA) and the state have responsibility for managing evacuations and distribution of Kl.

A commenter asked about the differences between Revisions 5 and 6 of NEI 99-01. The NRC staff stated that some of the changes related to lesson's learned, and more detailed discussions can be found in the NRC letter endorsing NEI 99-01, Revision 6. In response to another comment, the staff noted that the radionuclide release levels are based on FEMA guidance and NEI 99-01, Revision 6, continues to be ba~ed on the same levels as was used in previous revisions.

In response to another comment, the NRC staff stated that the proposed change would be submitted as an amendment, and that members of the public could request a hearing when the proposed amendment is noticed in the Federal Register.

One commenter asked if the proposed amendment was related to a Davis-Besse amendment regarding changes to the emergency diesel generator voltage and frequency setpoints. The NRC staff informed the commenter that there was no relationship between the two amendment requests.

Other comments concerned the history of issues at Davis-Besse (e.g., shield building cracking) and the potential downwind effects of a release.
