NOTICE OF VIOLATION (NRC INSPECTION REPORT NOS. 50-250/88-01 AND 50-251/88-01)
This refers to the Nuclear Regulatory Commission (NRC) inspection conducted on February 22-25, 1988, at the Turkey Point Nuclear Plant.
This inspection was an Emergency Response Facilities (ERF) Appraisal.
The report documenting this inspection was sent to you by letter dated April 12, 1988.
As a result of this inspection, failure to comply with regulatory requirements were identified, and accordingly, NRC concerns relative to the inspection findings were discussed in an Enforcement Conference held on April 21, 1988.
The report documenting this conference was sent to you by letter dated May 10, 1988.
The violations, which are described in the enclosed Notice of Violation, involved the failure to implement control room chart modifications for the delta T meteorological input for the Class A Dose Assessment Model and failure to establish and implement a software control procedure to ensure maintenance and control of the Class A Dose Assessment Computer Model.
Although the first of these violations would normally be classified at Severity Level III in accordance with "General Statement of Policy and Procedures for NRC-Enforcement Actions,"
CFR Part 2, Appendix C
( 1987), the violations, in this case, are both classified at Severity Level IV because:
(1)'he Control Room staff and Emergency Director had two additional methods to use to make Protective Action Recommendations; (2) historical meteorological data indicated that conditions resulting in large non-conservative dose estimates occur one percent or less of the time; and (3) prompt corrective action was taken.
'owever, we emphasize that any similar violation in the future may result in additional enforcement action.

You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response.
In your response, you should document the cause of this violation as well as specific actions taken and any additional actions you plan to prevent recurrence.
After review of your response to this Notice, including your proposed corrective actions, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.
