Oath and Affirmation of BVY 98-102 In Reference (a) Vermont Yan*4ec provided to the NRC, under oath and affirmation, a license amendment request that would reduce the normal operating suppression pool water temperature limit from 100 F to 90 F and would add a time restriction for the higher temperature allowed during surveillances that add heat to the suppression pool. Following submittal of this proposed change, the Staff verbally requested that Vermont Yankee docket the calculation used to determine the peak suppression pool temperature. Accordingly, Reference (b) provided the subject calculation.

In Reference (c), the Staff documented that when Vermont Yankee provides additional information to the NRC in support of a license amendment request, that the additional information must be submitted under oath and affirmation. The Staff upheld this belief for Vermont Yankee during a discussion on September 29,1998.

Accordingly, please accept this letter as providing the oath and affirmation for Reference (b).
