Dear Mr. Soler:

By letter dated September 16,1999, the Vermont Yankee Nuclear Power Corporation submitted your affidavit dated September 13,1999, requesting that the information titled Holtec .

Position Paper WS-115, Revision 1, "3D Single Rcck Analysis of Fuel Racks"; Holtec Report HI 87113, Revision 0," Evaluation of Fluid Flow for in-Phase and Out-of Phase Rack Motions"; )

. Holtec Report Hi-87114, Revision 0, " Estimated Effects of Vertical Flow Between Racks and Between Fuel Cell Assemblies"; Holtec Report Hi-87102, Revision 0," Study of Non-Linear Fluid Coupling Effects"; and Holtec Report HI-87112, Revision 0," Fluid Flow in Narrow Channels Surrounding Moving Rigid Bodies;" be withheld from public disclosure pursuant to 10 CFR 2,790.

The affidavit stated that the information submitted should be considered exempt from mandatory public disclosure since it constitutes: j

Therefore, the information submitted end marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.700(b)(5) and Section 103(b) cf the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspe.ct the documents. If the need arises, we may send copies of this information to our conse..iltants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary inforrnation.

If the basis for withholding this informat'on i from public inspection should change in the future auch that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act
