RESPONSE TO NRC REQUEST FOR INFORMATION REGARDING LICENSED OPF.RATOR POSITIVE DRUG TEST

Dear Sir:

By Reference b), NRC requested certain additional Information rogarding a report made by Vermont Yankee on June 26,1992 of an NRC-licensed operator who tested positive 'following a fitness-for-duty test. At the time of the incident, the individual was assigned as en Instructor at our corporate training center. He has since returned to work -following an eighteen day suspension, is currently receiving counceling through the Vermont Yankee Employee Assistance Program, and wil! be subjected to accelorated random drug screening for a parlod of elghteen months.

Attached as Enclosure B, please find Vermont Yankee's response to the additional Information requested in Reference b).

'Under the provisions of 10CFR2.790(a)(6), Vermont Yankee reqbosts that the information contained in Enclosure B be withhold from public disclosure, sinco Enclosure B contains " personnel and medical files and similar files, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy". In accordance with 10CFR2.790(b), an affidavit attesting to the confidential nature of the enclosed information is attached as Enclosure A.

The information for which confidential treatment is sought is contained in Enclosure B to our letter, Vermont Yankee Nuclear Power Corporation to U.S. Nuclear Re0ulatory Commission, dated July 17,1992.

Pursuant to the provisions of Paragraph (b)(4) of Section 2.790 of the Comm!ssion's regulations, the following is furnished for consideration by the Commission in determining whether the information sought to be withheld from public disclosure, included in the above referenced document, should be witnhold.

1. The material contained in this transmittal constitutes personnel and medical files and similar files, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy.
2. The material contained in this transmittalls of the type customarily held in confidence and not customarily disclosed to the public.
3. This inSrmation is being transmitted to the Commission in confidence undcr the provisions of 10CFR2.790 with the understanding that it is to be received in conflder,ce by the Cornmission.
4. This Information is for Commission internal use only and should not be released to persores or organizations outside the Dimctorate of Regulation and the ACRS without prior approval of Vermont Yankee Nuclear Power Corporation.
