Atapproximately 0810hoursonSeptember 7,1999,anotherdeadgreenseaturtle,weighingapproximately 12lbs.,wasrecovered fromtheplantintakecanal.Thisturtle,whichwasonlyslightlydecomposed, wasfoundagainstthe8-inchbarriernetlocatedattheA1ABridge.Atapproximately 1100hoursonSeptember 19,1999,aseverelydecomposed greenseaturtleweighingapproximately 25lbs.wasalsofoundagainstthe8-inchbarriernet.Thesemortalities bringthetotaltofourforthisspeciessofarthisyearattheSt.LuciePlant.Thelimitsformortalities ofthisspeciesintheNationalMarineFisheries Incidental TakeStatement, issuedtothesitebytheNRCin1997,isthreeor1.5%ofthetotalcaptured, whichever isgreater.Todate,thetotalnumberofgreenseaturtlescaptured((100)hasnotapproached thequantitynecessary toincreasetheincidental takebypercentage.

CAUSEOFTHEEVENTSThe5-inchturtlebarriernet,whichwasinstalled upstreamofthe8-inchbarriernet,hadbeenloweredduetoheavyloading,ofdriftalgaeapproximately 8dayspriortothefirstmortality.

ThisnethadtobeloweredagainSeptember 13,1999,duetotheapproachofHurricane Floyd.Ithasbeendetermined thatcatastrophic damagetothisnetcanoccurifabnormaltensionisplacedonthecablesandanchors.Severalturtleswereobservedbehindthe8-inchbarriernetpriortothemortalities, butcaptureeffortsprovedlargelyunsuccessful.

Thesmallturtlefoundintheplantintakewellwassmallenoughtopassthroughboththe8-inchnetandtheplantUnderwater Intrusion Detection System.-Itisnotknownifthisturtleactuallydiedintheintakewellorsomewhere upstreamofthewell.Thetwoturtlesfoundatthe8-inchbarriernetwerenotentangled inthenetitself.Therewerenosignsofexternalinjuryonthefirstturtle.Thesecondturtlewastoobadlydecomposed tomakeanydetermination.

Fromthisevidence, causeofthedeathscouldnotbedetermined.

fTheinfluxofdriftalgaeisattributed toincreased waveactionoffshoreresulting fromHurricane Dennis.Thisstormpassedrelatively closetotheEastCoastofFlorida.Following tg St.LucieUnits1and2DocketNos.50-335and50-389I99-214Attachment Page2Theinfluxofdriftalgaeisattributed toincreased waveactionoffshoreresulting fromHurricane Dennis.Thisstormpassedrelatively closetotheEastCoastofFlorida.Following Hurricane Dennis,Hurricane Floydalsopassednearthecoast,alsocreatinghighwindsandseas.Althoughitisnotpresently knownwhatcausedthedeathofthethreegreenseaturtles,theharshconditions offshoreandsubsequently inthecanalcouldhavebeenacontributing factor.CORRECTIVE ACTIONSCanalconditions allowedthe5-inchbarriernettoberaisedbackintopositionSeptember 16,1999.Thisnet,duetoitssteeperandsmallermeshdesign,ismoreeffective inretaining turtlesinanareaofthecanalwheretheycanbeeffectively captured.

Captureeffortshavebeenincreased behindthe5-inchnetuntiltheremaining'turtles areremoved.Section4.2.1(1)requiresreinitiation offormalconsultation iftheamountorextentoftakingspecified intheIncidental TakeStatement isexceeded.

Duetosomewhatunusualoffshoreenvironmental conditions andtheapparentincreaseinlocalpopulations, thenumberofgreenseaturtlemortalities for1999hasexceededtheIncidental TakeStatement limitforthisspeciesatSt.Lucieplant.FPLrequeststhattheNRCbeginthenecessary stepstoreinitiate formalconsultation underSection7oftheEndangered SpeciesActforgreenseaturtles.AGENCIESNOTIFIEDTheFloridaDepartment ofEnvironmental Protection wasnotifiedofthethreemortalities incompliance withMarineTurtlePermit¹99.Four-hour notifications weremadetotheNRCat0225hoursonSeptember 6,1999,at1226hoursonSeptember 7,1999,andat1324hoursonSeptember 19,1999,inaccordance with10CFR50.72(b)(2)(vi).
