NOTICE OF VIOLATION

Dear Mr. Morey:

On May 30 1998. the U.S. Nuclear Regulatory Commission (NRC) completed an

inspection at your Farley Nuclear Plant (FNP).

The enclosed report presents

the.results of that inspection,

During the 7-week period, your conduct of activities at FNP was generally

characterized by safety-conscious operations, sound engineering and

L

maintenance practices, and careful radiological work controls. However, three-

violations of NRC requirements were identified regarding:

(A) Inadequate

corrective actions for conditions adverse to quality associated with the

Control Room Ventilation System.(CRVS). (B) Failure to remove eight

, individuals from the protected area access list and (C) Inadequate safety-

assessment of the event re)orted by~ Licensee Event Report 97-10.. We are

particularly concerned wit 1 Violation A.

Although you identified several

L

instances where inadequate corrective actions were taken to resolve CRVS

i

Functional System Description (FSD) open items, and discretion could have been-

l

-applied, we decided that this violation warrants citation because of the

multiple examples; involved and the extended duration they existed.

These violations are cited in the enclosed Notice of Violation (Notice) and

the' specific circumstances surrounding these violations are described in

/

detail in the enclosed report.

to this letter and should follow the instructions specified in the enclosed

. Notice when preparing your response. The NRC will use your response, in part.

tto determine whether further enforcement action is necessary to ensure

compliance with regulatory requirements.

In your response to Violation A you

are also requested to inform us how you plan to address the inappropriate

closure of CRVS-FSD open items for the other systems that have an FSD to

. verify adequate. closure and resolution of open items. With regard to

Violation C. the NRC has concluded that the information regarding the reason

for the violation, the corrective actions taken and planned to correct the

violation and prevent recurrence are already adequately addressed in this

inspection report. ' Therefore, you are not required to respond to the third

violation unless the description herein-does not accurately reflect your

corrective actions or your position.

In that case if you choose to provide

additional information, you should follow the instructions specified in the

enclosed Notice.

In addition to the aforementioned violations, an apparent violation was

identified and is being considered for escalated enforcement action in

accordance with the NUREG-1600. " General Statement of Policy and Procedures

for NRC Enforcement Actions." This apparent violation concerned several

mis-wired motor-operated valves (MOVs) at the hot shutdown panel (HSDP) that

adversely impacted the ability of operators to safely shutdown and cooldown

the plant in the event of a fire in the main control room or cable spreading

room.

You will be advised by separate correspondence of the results of our

. deliberations on this matter.

No response regarding the apparent violation is

required at this time.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice." a copy of

this letter and its enclosures will be placed in the NRC Public Document Room.
